CONCERNING THE PRIORITIZED LIST OF PROJECTS FOR WHICH THE STATE TREASURER IS AUTHORIZED TO ENTER INTO LEASE-PURCHASE AGREEMENTS. WHEREAS, Pursuant to section 23-29.9-102, Colorado Revised Statutes, as enacted in Senate Bill 08-218, enacted in the Second Regular Session of the Sixty-sixth General Assembly, the higher education federal mineral lease revenues fund ("revenues fund") was created to provide funding for capital construction projects at state-supported institutions of higher education; and WHEREAS, Pursuant to section 23-1-106.3, Colorado Revised Statutes, as enacted in Senate Bill 08-233, enacted in the Second Regular Session of the Sixty-sixth General Assembly, the Colorado Commission on Higher Education and the Office of State Planning and Budgeting have submitted to the Capital Development Committee prioritized lists of capital construction projects at state-supported institutions of higher education that are appropriate for lease-purchase agreements to be funded from the revenues fund; and WHEREAS, The Capital Development Committee has reviewed the prioritized lists and submitted to the Joint Budget Committee its prioritized list of capital construction projects at state-supported institutions of higher education that are appropriate for lease-purchase agreements to be funded from the revenues fund; and WHEREAS, Pursuant to section 23-1-106.3, Colorado Revised Statutes, the Joint Budget Committee is directed to sponsor a Joint Resolution identifying a prioritized list of capital construction projects at state-supported institutions of higher education that are appropriate for lease-purchase agreements to be funded from the revenues fund; and WHEREAS, Pursuant to section 23-1-106.3, Colorado Revised Statutes, the State Treasurer is authorized to enter into lease-purchase agreements on projects in accordance with the prioritized list contained in this Joint Resolution, subject to the limitations contained in section 23-1-106.3, Colorado Revised Statutes; now, therefore, Be It Resolved by the House of Representatives of the Sixty-sixth General Assembly of the State of Colorado, the Senate concurring herein: (1) That the following prioritized list contains the name of the institution, the name of the project, the principal amount of money to be raised through lease-purchase agreements to be paid from the revenues fund, the principal amount of money that the institution is to contribute to the project, and the total anticipated cost of the project: Institution / Project State Share Institution Share Total Project 1. Colorado State University / Chemistry Building Addition $40,000,000 $5,000,000 $45,000,000 (2) The State Treasurer is authorized to enter into lease-purchase agreements according to the list specified in subsection (1) of this Joint Resolution but only to the extent that funding for the projects is available; except that, if there is insufficient money available to fully fund that last project on the list for which funding is available, the State Treasurer is authorized to enter into a lease-purchase agreement for the next project or projects on the list for which there is sufficient money to fully fund the project.
