Senator Isgar introduced prepared amendment L.008 (Attachment D).

Heidi Van Huysen, Department of Natural Resources, addressed the committee and discussed amendment L.008 (Attachment D). She explained that the amendment addresses the authority of the state engineer to hold public hearings for people who object to the approval of a substitute water supply plans.

Senator Harvey explained that there was still opposition to the bill by the Centennial Water District despite prepared amendment L.008 (Attachment D). Committee discussion ensued concerning augmentation plans to meet future depletions and the impact of Senate Bill 08-247 to apply to other river basins, not just specific to water from the Colorado Big Thompson project.

The committee discussed whether the bill was necessary and whether water districts could change their own bylaws to implement substitute water supply plans for the replacement of out-of-priority depletions.
