11:38 AM -- House Bill 08-1013 - Concerning a Sales Tax Exemption for Items Sold By Schools


Representative Sonnenberg, prime sponsor, explained that House Bill 08-1013 provides a sales tax exemption for items sold by schools, parent or teacher organizations, booster clubs, and other groups or clubs whose primary purpose is to support a school activity.

The following persons testified,

11:40 AM -- Ms. Kjirsten Olme, Sterling High School, testified in support of the legislation.

Ms. Ali Pilkington, Sterling High School, testified in support of the bill and noted that money that is being raised through school booster and other clubs, needs to be retained by the schools. She closed by urging the committee to support the bill.

11:51 AM --
Mr. Phillip Horwitz, Colorado Department of Revenue, responded to committee questions about the application of the exemption in the bill. Mr. Horwitz noted that from a sales tax point of view, it may be interesting to apply the exemption at a school's point of purchase, rather than at the point of sales. The difference being significant because schools buy more in absolute dollar volume than schools sell through clubs and organizations.

After a brief committee discussion, Representative Judd laid over House Bill 08-1013 and noted that the bill would be rescheduled in the future but with another similar bill that at the time of this hearing, has not yet been introduced in the legislature.
