      BY REPRESENTATIVE(S) Frangas, Borodkin, Kerr A., McGihon, and
      Todd;
      also SENATOR(S) Romer, Spence, and Williams.
      
      
      Concerning the regulation of lease rates of motor vehicles that
           are regulated pursuant to the issuance of certificates of
           public convenience and necessity to operate a motor vehicle
           for hire as a taxicab, and making an appropriation therefor.
       
      
      Be it enacted by the General Assembly of the State of Colorado:
      
           SECTION 1.  40-3-103, Colorado Revised Statutes, is amended to
      read:
      
           40-3-103.  Utilities to file rate schedules - rules.  Under such rules
      and regulations as the commission may prescribe, every public utility shall
      file with the commission, within such time and in such form as the
      commission may designate, and shall print and keep open to public
      inspection, schedules showing all rates, tolls, rentals, charges, and
      classifications collected or enforced, or to be collected and enforced,
      together with all rules, regulations, contracts, privileges, and facilities which
      that in any manner affect or relate to rates, tolls, rentals, classifications, or
      service. except that the commission may not prescribe by rule or regulation
      the lease rate that is charged to a driver of a motor vehicle by a common or
      contract carrier.  Changes in such lease rates shall not be subject to the
      notice provision of section 40-3-104.
      
           SECTION 2.  Appropriation.  In addition to any other
      appropriation, there is hereby appropriated, out of any moneys in the public
      utilities commission motor carrier fund created in section 40-2-110.5 (6),
      Colorado Revised Statutes, not otherwise appropriated, to the department
      of regulatory agencies, for allocation to the public utilities commission, for
      the regulation of taxicab owners and drivers, for the fiscal year beginning
      July 1, 2007, the sum of four thousand eight hundred seventy-eight dollars
      ($4,878), or so much thereof as may be necessary, for the implementation
      of this act.
      
           SECTION 3.  Safety clause.  The general assembly hereby finds,
      determines, and declares that this act is necessary for the immediate
      preservation of the public peace, health, and safety.
