Representative B. Gardner moved Bill 1 (Attachment A). Bill 1 creates a set aside program for nonprofit agencies that employ persons with severe disabilities and allows nonprofit agencies to bid on certain types of state services solicitations. Representative B. Gardner moved amendment L.002 (Attachment C) which is a strike-below amendment. He responded to questions from Senator Keller regarding whether the bill had previously encompassed for-profit entities, and Representative B. Gardner responded that it did not. Representative B. Gardner further responded to questions from Senator Renfroe regarding whether the bill required a specific percentage of a nonprofit's employees to have developmental disabilities, and Representative B. Gardner discussed the bill's requirement that 75 percent of the employees hired under the contract awarded pursuant to the bill be persons with severe disabilities and a minimum of 20 percent be persons who have developmental disabilities. Representative B. Gardner responded to questions from Representative Pommer regarding whether the bill would lead to segregation of persons with developmental disabilities in the workplace.

Representative Garcia asked for sponsors for the bill. Representative B. Gardner agreed to carry the bill in the House, and Senator Boyd agreed to be the Senate sponsor of the bill. Senators Williams and Keller and Representatives Soper, Pommer, and Garcia asked to be cosponsors for the bill. The committee agreed to permit the Office of Legislative Legal Services (OLLS) to make technical changes to the bill, and agreed that the bill should have an effective date clause rather than a safety clause.
