10:23 AM -- Bill 2

Jerry Barry, Office of Legislative Legal Services, presented Bill 2 concerning eligibility for Medicaid family planning (Attachment D). The bill directs the Department of Health Care Policy and Financing to seek a federal waiver to establish family planning services to categorically eligible individuals who are at or below a percentage of the federal poverty level. The bill does not specify a percentage of the federal poverty level, essentially removing the income limitations for eligibility. Mr. Barry explained amendment L.001 (Attachment E).

Ginny Brown, Legislative Liaison from the Department of Health Care Policy and Financing, distributed a packet of information about the Colorado Family Planning Medicaid Expansion Project and responded to questions from the committee (Attachment F). Senator Kopp asked whether the presumptive eligibility piece is included in the bill. Ms. Brown stated the presumptive eligibility piece is not in the bill and is excluded from the federal waiver because the Centers for Medicare and Medicaid are not approving waivers that include presumptive eligibility. She introduced one of the department's program staff members, Margaret Mohan, who was available to give further details. Ms. Mohan talked about an in-service she recently attended with the Centers for Medicare and Medicaid Services and several states which have implemented the family planning waiver along with states that are attempting to implement the waiver, and they indicated that waivers with presumptive eligibility were no longer being approved, so the department decided to pull the presumptive piece out of the waiver. Representative Swalm asked about the existence of an amendment to the state constitution that prohibits the state from funding abortions and an Executive Order issued by Governor Owens that prohibited funding for planned parenthood. Ms. Brown stated that those do exist, and that she is currently conducting research to determine whether the bill conflicts with Governor Owens' Executive Order.

Senator Boyd asked if Governor Ritter rescinded that Executive Order. Ms. Brown was unsure. Representative Swalm continued and asked how the state complies with the order and insures that state money does not go towards abortions or to planned parenthood. Ms. Mohan explained that family planning is a mandated service through Medicaid, and that the state ensures that abortion services are not provided under the family planning services by monitoring providers, approved procedures, and coding for those procedures.
