Senator Fitz-Gerald called the meeting to order.

Senator Linkhart presented SB 74. He distributed a memo summarizing the provisions of SB 74 (Attachment A) and acknowledged that the bill is similar to a bill that passed in the Senate last session.

03:23 PM -- Raine Catalano testified in support of the bill because of her experience with employment discrimination due to her sexual orientation and gender identity disorder. She answered questions from the committee concerning the problems associated with employment discrimination.

Senator Linkhart stated the importance of ending employment discrimination for all persons.

03:28 PM -- Mari Newman, representing the American Civil Liberties Union and the Equal Rights Commission of Colorado, testified in support of the bill. She discussed some of the legal issues surrounding employment discrimination and added that employment decisions should be based on workplace performance. She stated that individuals who are discriminated against based on sexual orientation do not have the same legal recourse as other individuals with employment discrimination cases. She stated that SB 74 would clarify the law which would facilitate sexual orientation employment discrimination cases.

Ms. Newman answered questions from the committee concerning the legal issues surrounding sexual orientation discrimination.

Senator Linkhart concluded the discussion on SB 74 and asked for approval of the bill.

Senator Linkhart answered questions from the committee concerning the provisions of the bill, including the provision regarding religious organizations.
