A BILL FOR AN ACT Concerning the prohibition of the purchase of handguns at gun shows by persons under twenty-one years of age, and making an appropriation in connection therewith. Bill Summary (Note: This summary applies to this bill as introduced and does not necessarily reflect any amendments that may be subsequently adopted.) Prohibits the transfer of handguns at gun shows to persons under 21 years of age. Prohibits the purchase, trade, or rent of handguns at gun shows by persons under 21 years of age. Defines gun show. Makes a 5-year statutory appropriation. Be it enacted by the General Assembly of the State of Colorado: SECTION 1. Article 12 of title 18, Colorado Revised Statutes, is amended BY THE ADDITION OF A NEW SECTION to read: 18-12-111. Unlawful transfer and purchase of handguns at gun shows by persons under 21. (1) For purposes of this section: (a) "Gun show" means an event or a function, including but not limited to transactions occurring in any area used to accommodate parking for the event or function, sponsored by: (I) A national, state, or local organization devoted to the collection, competitive use, or other sporting use of firearms; or (II) An organization or association that sponsors functions devoted to the collection, competitive use, or other sporting use of firearms in the community. (b) "Transfer" means sale, trade, or rental by a transferor to a transferee. (c) "Transferee" means any person to whom a transferor wishes to transfer a firearm. (d) "Transferor" means any person who wishes to transfer a firearm and includes: (I) Any federal firearms licensee participating in a gun show as a federal firearms licensee; (II) Any non-federal firearms licensee participating in a gun show as a private citizen; (III) Any federal firearms licensee participating in a gun show as a private citizen. (2) It shall be unlawful for any person at a gun show to knowingly transfer a handgun to a person who is under twenty-one years of age. (3) It shall be unlawful for any transferor to fail to request identification from any transferee prior to the transfer of a handgun. (4) It shall be unlawful for any person who is under twenty-one years of age to purchase, trade, or rent a handgun at a gun show. (5) It shall be unlawful for any person in connection with the transfer or attempted transfer of a handgun from any transferor pursuant to this section, to knowingly make a false or fictitious oral or written statement or knowingly furnish or exhibit false, fictitious, or misrepresented identification that is intended or likely to deceive the transferor with respect to any fact material to the lawfulness of the transfer of a handgun pursuant to this section. (6) Any transferor or transferee who violates any provision of this section commits a class 1 misdemeanor; except that a violation of subsection (2) of this section that involves the transfer of a handgun to a person who is under twenty-one years of age shall constitute a class 4 felony. SECTION 2. Part 1 of article 1 of title 17, Colorado Revised Statutes, is amended BY THE ADDITION OF A NEW SECTION to read: 17-1-126. Appropriation to comply with section 2-2-703 - H.B. 00-____. (1) Pursuant to section 2-2-703, C.R.S., the following statutory appropriations, or so much thereof as may be necessary, are made in order to implement H.B. 00-___, enacted at the second regular session of the sixty-second general assembly: (a) For the fiscal year beginning July 1, 2000, in addition to any other appropriation, there is hereby appropriated from the capital construction fund created in section 24-75-302, C.R.S., to the corrections expansion reserve fund created in section 17-1-116, the sum of _____ dollars ($ ). (b) (I) For the fiscal year beginning July 1, 2001, in addition to any other appropriation, there is hereby appropriated, from the capital construction fund created in section 24-75-302, C.R.S., to the corrections expansion reserve fund created in section 17-1-116, the sum of _____ dollars ($ ). (II) For the fiscal year beginning July 1, 2001, in addition to any other appropriation, there is hereby appropriated to the department of corrections, out of any moneys in the general fund not otherwise appropriated, the sum of _____ dollars ($ ). (c) (I) For the fiscal year beginning July 1, 2002, in addition to any other appropriation, there is hereby appropriated, from the capital construction fund created in section 24-75-302, C.R.S., to the corrections expansion reserve fund created in section 17-1-116, the sum of _____ dollars ($ ). (II) For the fiscal year beginning July 1, 2002, in addition to any other appropriation, there is hereby appropriated to the department of corrections, out of any moneys in the general fund not otherwise appropriated, the sum of _____ dollars ($ ). (d) (I) For the fiscal year beginning July 1, 2003, in addition to any other appropriation, there is hereby appropriated, from the capital construction fund created in section 24-75-302, C.R.S., to the corrections expansion reserve fund created in section 17-1-116, the sum of _____ dollars ($ ). (II) For the fiscal year beginning July 1, 2003, in addition to any other appropriation, there is hereby appropriated to the department of corrections, out of any moneys in the general fund not otherwise appropriated, the sum of _____ dollars($ ). (e) (I) For the fiscal year beginning July 1, 2004, in addition to any other appropriation, there is hereby appropriated, from the capital construction fund created in section 24-75-302, C.R.S., to the corrections expansion reserve fund created in section 17-1-116, the sum of _____ dollars ($ ). (II) For the fiscal year beginning July 1, 2004, in addition to any other appropriation, there is hereby appropriated to the department of corrections, out of any moneys in the general fund not otherwise appropriated, the sum of _____ dollars($ ). SECTION 3. Safety clause. The general assembly hereby finds, determines, and declares that this act is necessary for the immediate preservation of the public peace, health, and safety.
