BUSINESS AFFAIRS AND LABOR
After consideration on the merits, the Committee recommends the following:
HB00-1446 be referred to the Committee of the Whole with favorable recommendation.
HB00-1447 be amended as follows, and as so amended, be referred to the Committee of the Whole with favorable recommendation:
Amend printed bill, page 3, strike lines 7 through 23.
Renumber succeeding sections accordingly.
Page 4, line 8, strike "July 1, 2000;" and substitute "January 1, 2001;";
line 11, strike "immediately upon" and substitute "upon five days'";
after line 17, insert the following:
"(4) With the exception of price reductions pursuant to this section, nothing in this article shall be construed to nullify or otherwise affect any existing agreement or proceeding between or among the public utilities commission and a provider or providers of part 2, part 3, or, to the extent permitted by the federal "Telecommunications Act of 1996", part 5 telecommunications services that was commenced, entered into, or in effect on or before the effective date of this section.";

"1995, for comparable service; except that as follows:
(A) The price of such service may be adjusted by an amount equal to the change in the United States gross domestic product price index. minus an index that represents telecommunications productivity changes as determined by the commission. This adjustment shall be granted only to the extent the commission determines an adjustment is required to cover reasonable costs. and shall not exceed five percent in any one year. The amount of the adjustment, as applied to rural telecommunications providers, may be different from the amount of the adjustment as applied to providers other than rural telecommunications providers.
(B) Notwithstanding sub-subparagraph (A) of this subparagraph (I), prices for residential basic local exchange service, including zone charges, if any, charged by a rural telecommunications provider that is cooperatively owned may rise above the levels in effect on May 24, 1995, for comparable service upon the affirmative vote of at least two-thirds of the members of the governing body of such a provider.
(I.5) The commission shall not allow prices for residential basic service plus zone charges to increase outside base rate areas by an amount greater than any price increase within base rate areas.";

FINANCE
After consideration on the merits, the Committee recommends the following:
HB00-1462 be amended as follows, and as so amended, be referred to the Committee on Appropriations with favorable recommendation:
Amend printed bill, page 9, line 18, strike "section." and substitute "section; except that, if a qualified taxpayer claims the tax credit authorized by section 39-22-124 for taxable personal property, the amount of the credit allowed under this section shall be reduced by an amount equal to the amount of the credit received by the qualified taxpayer pursuant to section 39-22-124.".

"(d) The Colorado economic development commission shall make a decision to approve or disapprove a certification application submitted by a taxpayer pursuant to paragraph (a) or (b) of this subsection (5) within forty-five days after such submission. If the Colorado economic development commission fails to make a decision within said forty-five days, the taxpayer shall be automatically certified as qualified to claim the credit authorized by subsection (3) of this section.".
TRANSPORTATION AND ENERGY
After consideration on the merits, the Committee recommends the following:
HB00-1430 be amended as follows, and as so amended, be referred to the Committee on Appropriations with favorable recommendation:
Amend printed bill, page 2, line 5, strike "section 29-4-719.1 (2) (f) (IV)," and substitute "section 29-4-719.1 (2) (f) (I) (A.5),";
line 26, after the period, add "The commission shall biennially report to the general assembly about the status of such efforts, including an assessment of the activities of individuals or entities receiving grants from the fund.".

HM00-1003 by Representative Hoppe--Memorializing former Representative John G. Hamlin.
WHEREAS, By the Will of Divine Providence, our beloved former member, John G. Hamlin, departed this life on January 25, 2000, at the age of 79; and
WHEREAS, Representative Hamlin was born June 28, 1920, in Twin Valley, Minnesota; and
WHEREAS, Representative Hamlin graduated from Spring Valley High School located in Twin Valley, Minnesota; and
WHEREAS, Representative Hamlin, following service in the United States Air Force as a B-17 pilot, worked as construction foreman for Donovan Construction in Chicago; and
WHEREAS, Representative Hamlin moved to Fort Morgan in 1949 and founded Hamlin Electric Co. with his brother, Neal; and
WHEREAS, Representative Hamlin served as Director of Morgan Federal Bank in Fort Morgan; and
WHEREAS, Representative Hamlin served on the Fort Morgan City Council and as Fort Morgan mayor; and
WHEREAS, Representative Hamlin served as commander of the local and state VFW; and
WHEREAS, Representative Hamlin served as president of the Colorado Municipal League and the Rotary Club; and
WHEREAS, Representative Hamlin was a member of the Fort Morgan Chamber of Commerce and the Fort Morgan Industrial Foundation; and
WHEREAS, Representative Hamlin was instrumental in the success of the founding of Morgan Community College; and
WHEREAS, Representative Hamlin served well and faithfully in the Colorado House of Representatives from 1972 to 1986; and
WHEREAS, Representative Hamlin served on the Rules Committee and the Labor and Employment Relations Committee; and also served as chair of the Health, Environment, Welfare, and Institutions Committee; chair of the Local Government Committee; and chair of the Business Affairs and Labor Committee; and
WHEREAS, Representative Hamlin served on more than twenty interim committees in the course of his legislative service; and
WHEREAS, Representative Hamlin served as Republican majority leader for the Fifty-second General Assembly; and
WHEREAS, Representative Hamlin was chosen as Legislator of the Year in 1986; and
WHEREAS, Representative Hamlin was ranked number one among his peers in a survey of Colorado legislators in 1986; and
WHEREAS, Representative Hamlin loved baseball and was an ardent fan of the Colorado Rockies; and
WHEREAS, Representative Hamlin was named Fort Morgan Area Chamber of Commerce Citizen of the Year two days before he died; and
WHEREAS, It is fitting that we, the members of the House of Representatives of the Sixty-second General Assembly, pay tribute to the years of dedicated public service of Representative Hamlin and express our deep regret and sorrow occasioned by his death; now, therefore,
Be It Resolved by the House of Representatives of the Sixty-second General Assembly of the State of Colorado:
That, in the death of John G. Hamlin, the people of the state of Colorado have lost a dedicated public servant and an outstanding citizen, and that we, the members of the House of Representatives of the Sixty-second General Assembly, do hereby extend our deep and heartfelt sympathy to the members of his family and pay tribute to a man who served his state well and faithfully; and
Be It Further Resolved, That copies of this Memorial be sent to Representative Hamlin's wife, Vicki; his two sons, George and William; his brother, Kenneth; his sister, Lois; and his five grandchildren.______________

23-1-121. Commission directive - approval of teacher preparation programs. (5) The commission, upon the request of a nonpublic institution that provides a teacher preparation program, shall approve the program upon:
(a) Receipt of confirmation by the state board of education that the program content is designed and implemented in a manner that will enable a teacher candidate to meet the requirements specified by the state board of education pursuant to section 22-2-109 (3), C.R.S., and the requirements for licensure endorsement adopted by rule of the state board of education pursuant to section 22-60.5-106, C.R.S.; and
(b) Confirmation that the program contains the requirement of a minimum of eight hundred hours of supervised field-based experience including, but not limited to, supervised field-based experience gained prior to admission to the teacher preparation program, general field-based experience, and student teaching.
(6) Beginning January 2002, the commission".

Amend reengrossed bill, page 2, after line 15, insert the following:
"SECTION 3. 22-60.5-114, Colorado Revised Statutes, is amended BY THE ADDITION OF A NEW SUBSECTION to read:
22-60.5-114. State board of education - waivers. (3) Upon application by a school district or board of cooperative services, the state board may grant a waiver of the requirement that a person applying for a provisional license demonstrate professional competencies. Such a waiver may be granted only by a two-thirds majority vote of the board members following a demonstration that:
(a) The license applicant is employed by the school district or board of cooperative services under an authorization issued pursuant to section 22-60.5-111;
(b) Enforcement of the requirement would cause extreme hardship to the school district or board of cooperative services or to the license applicant; and
(c) The skill level of the license applicant is comparable to the skill level of an applicant who has successfully demonstrated professional competencies. The school district or board of cooperative services shall provide documentary evidence of the skill level of the license applicant.".

(II) If, based on the financial report prepared by the controller in accordance with section 24-77-106.5, C.R.S., the controller certifies that the amount of excess state revenues for any state fiscal year commencing on or after July 1, 2001, will not exceed the limitation on state fiscal year spending imposed by section 20 (7) (a) of article X of the state constitution or if voters statewide authorize the state to retain and spend all of the excess state revenues for any state fiscal year commencing on or after July 1, 2001, then the state income tax modification authorized by subparagraph (I) of this paragraph (l.5) shall not be allowed for the income tax year in which such state fiscal year ended.
(III) If one or more ballot questions that seek authorization for the state to retain and spend all or any portion of the amount of excess state revenues for the immediately preceding state fiscal year are submitted to the voters at a statewide election to be held in November of any calendar year commencing on or after January 1, 2000, the executive director shall not determine whether the state income tax modification authorized by subparagraph (I) of this paragraph (l.5) shall be allowed for any income tax year commencing on or after January 1, 2001, and shall not promulgate rules containing said state income tax modification until the impact of the results of said election on the amount of the excess state revenues to be refunded is ascertained.
(IV) The general assembly hereby finds and declares that excluding certain interest income, dividend income, and net capital gains from federal taxable income for state income tax purposes as authorized by this paragraph (l.5) is a reasonable method of refunding a portion of the excess state revenues required to be refunded in accordance with section 20 (7) (d) of article X of the state constitution.".

"(a) The Colorado state patrol provides vital services to the citizens of Colorado in law enforcement, highway safety, and the protection of life, safety, and property. Troopers in the Colorado state patrol must be uniquely trained to meet the expectations of the citizens of Colorado in professionalism, integrity, judgment, and courtesy.
(b) Troopers' duties include serving at duty posts throughout the state, from highly populous metropolitan areas to remote rural areas, and troopers are often required to relocate themselves and their families in order to satisfy such duty assignments. The troopers must have adequate training and experience to make independent decisions in the interest of law enforcement, service, and protection. The troopers carry out law enforcement activities including initial contact, investigation, and prosecution, often without backup or on-scene supervision.
(c) The state experiences a significant loss when a well trained trooper leaves the Colorado state patrol, as the state invests extensive resources in the recruitment and training of the troopers.
(d) Total compensation for the troopers is established by a survey of other law enforcement agencies. In recent years, due to the market surveyed and the method of calculating survey results, compensation for the Colorado state patrol troopers has fallen below that of other law enforcement agencies of similar size and experience. This trend has resulted in a significant loss of trained troopers in the state. Therefore, it is in the interest of the state to offer troopers competitive compensation and to ensure that the Colorado state patrol will be able to recruit and retain troopers.".

"(5) (a) Notwithstanding the provisions of subsection (1) of this section, for any income tax year beginning on or after January 1, 2000, if, based on the financial report prepared by the state controller in accordance with section 24-77-106.5, C.R.S., the controller certifies that the amount of state revenues for the state fiscal year ending in that income tax year exceeds the limitation on state fiscal year spending imposed by section 20 (7) (a) of article X of the state constitution and the voters statewide either have not authorized the state to retain and spend all of the excess state revenues or have authorized the state to retain and spend only a portion of the excess state revenues for that fiscal year, any resident individual who claims a credit for child care expenses on the individual's federal income tax return shall not be allowed a credit under subsection (1) of this section but".

(6) Any credit allowed for any given income tax year pursuant to subsection (5) of this section shall be published in rules promulgated by the executive director in accordance with article 4 of title 24, C.R.S., and shall be included in income tax forms for that income tax year.
(7) If one or more ballot questions are submitted to the voters at a statewide election to be held in November of any calendar year commencing on or after January 1, 2000, that seek authorization for the state to retain and spend all or any portion of the amount of excess state revenues for the state fiscal year ending during said calendar year, the executive director shall not determine whether the credits authorized by subsection (5) of this section shall be allowed and shall not promulgate rules containing said credits until the impact of the results of said election on the amount of the excess state revenues to be refunded is ascertained.
(8) The general assembly finds and declares that the child care tax credit and child tax credit authorized by subsection (5) of this section are reasonable methods of refunding a portion of the excess state revenues required to be refunded in accordance with section 20 (7) (d) of article X of the state constitution.".
