Amend reengrossed bill, page 5, line 1, strike "Denver international airport" and substitute "the city of Golden";
line 2, strike "right-of-way." and substitute "right-of-way that topographical constraints would require the authority to use in order to build a full monorail system between the city of Golden and Eagle county airport. The term also includes any existing railroad rights-of-way that lie between Denver international airport and the city of Golden and are large enough to contain a monorail system without requiring the condemnation of adjacent residential or commercial property.".

(b) Four directors appointed by the governor, two of whom shall be members of the board of directors of the regional transportation district created in section 32-9-105 and one of whom shall be a member of the transportation commission created in section 43-1-106, C.R.S., and whose appointments shall be subject to the consent of the senate; and
(c) Six directors appointed without regard to affiliation by the governing body of each county or city and county included in the territory of the authority.
(2) The directors appointed pursuant to paragraph (c) of subsection (1) or paragraph (c) of subsection (1.5) of this section shall reside in the county from which they are appointed. The directors appointed pursuant to paragraphs (a) and (b) of subsection (1) or paragraphs (a) and (b) of subsection (1.5) of this section shall reside in the state of Colorado.
(3) (b) The directors appointed pursuant to paragraph (a) of subsection (1) or paragraph (a) of subsection (1.5) of this section shall be appointed for two-year terms. The directors appointed pursuant to paragraph (b) of subsection (1) or paragraph (b) of subsection (1.5) of this section shall be appointed for three-year terms. The directors appointed pursuant to paragraph (c) of subsection (1) or paragraph (c) of subsection (1.5) of this section shall be appointed for four-year terms.
(4) (a) At least two directors appointed pursuant to subsection (1) or (1.5) of this section shall be engineers.
(b) At least one director appointed pursuant to subsection (1) or (1.5) of this section shall have significant professional experience in freight or passenger transportation, and at least one director appointed pursuant to subsection (1) or (1.5) of this section shall have significant professional experience in a tourism-related occupation or profession.
(c) The directors appointed pursuant to paragraphs (a) and (b) of subsection (1) or paragraphs (a) and (b) of subsection (1.5) of this section shall have expertise in one or more areas that are relevant to the performance of the powers and duties of the board. Such areas of expertise may include, but are not limited to:
(I) Public finance;
(II) Private finance;
(III) Highway construction;
(IV) Engineering;
(V) Commercial law;
(VI) Commercial real estate;
(VII) Public transportation;
(VIII) Land use and environmental planning;
(IX) Real estate development; and
(X) General contracting.

Amend reengrossed bill, page 10, strike lines 8 through 11, and substitute the following:
"SECTION 5. Appropriation - adjustments to the 2000 long bill. (1) For the implementation of this act, appropriations made in the annual general appropriation act for the fiscal year beginning July 1, 2000, shall be adjusted as follows:
(a) The general fund appropriation to the department of health care policy and financing, medical services premiums, is decreased by one million eight hundred thirteen thousand six hundred ten dollars ($1,813,610).
(b) The federal funds reflected in the appropriation to the department of health care policy and financing, medical services premiums, is decreased by one million eight hundred thirteen thousand six hundred eleven dollars ($1,813,611).
(2) In addition to any other appropriation, there is hereby appropriated, from any moneys in the general fund not otherwise appropriated, to the department of health care policy and financing, medical services premiums, for the fiscal year beginning July 1, 2000, the sum of one million eight hundred thirteen thousand six hundred ten dollars ($1,813,610), or so much thereof as may be necessary, for the implementation of this act. In addition to said appropriation, the general assembly anticipates that, for the fiscal year beginning July 1, 2000, the department of health care policy and financing will receive the sum of one million eight hundred thirteen thousand six hundred eleven dollars ($1,813,611) in federal funds for the implementation of this act.".

After consideration on the merits, the Committee recommends the following:
SB00-192 be amended as follows, and as so amended, be referred to the Committee of the Whole with favorable recommendation:
Amend reengrossed bill, page 1, strike lines 2 through 6, and substitute the following:
"SECTION 1. 12-7-105 (1), Colorado Revised Statutes, is amended to read:
12-7-105. Reports and records required - bonding agents - division. (1) Commencing each November 1, 2000, each licensed bail bonding agent shall upon reasonable request, provide a report to the division no later than November 1 of each year. Such report shall include but is not limited to the following information to the division:
(a) The names of the persons for whom such bail bonding agent has become surety;
(b) A description of any bond activity;
(c) (Deleted by amendment, L. 96, p. 1183, § 8, effective June 1, 1996.)
(d) The amount of collateral or security received;
(e) (Deleted by amendment, L. 96, p. 1183, § 8, effective June 1, 1996.)
(e.5) The names of persons for whom such bail bonding agent has become surety and who have failed to appear;
(f) Such further information as the division may reasonably require.
SECTION 2. 16-4-105 (3) (e), Colorado Revised Statutes, is amended to read:
16-4-105. Selection by judge of the amount of bail and type of bond - criteria. (3) (e) Commencing November 1, 2000, each pretrial services program established pursuant to this subsection (3) shall provide an annual report to the chief judge of the judicial district which it serves state judicial department no later than November 1 of each year, regardless of whether the program existed prior to may 31, 1991. The judicial department shall present an annual combined report to the house and senate judiciary committees of the general assembly. The report shall include but is not limited to the following information:
(I) The number of interviews conducted with defendants;
(II) The number and nature of recommendations made;
(III) The number of defendants under pretrial release supervision who failed to appear; and
(IV) Any additional information the court state judicial department may request.".

This Report Amends the Rerevised Bill.
To the President of the Senate and the
Speaker of the House of Representatives:
Your first conference committee appointed on SB00-124, concerning literacy in early elementary grades, and, in connection therewith, establishing a read-to-achieve program, and making an appropriation in connection therewith, has met and reports that it has agreed upon the following:
1. That the Senate accede to the House amendments made to the bill, as said amendments appear in the rerevised bill, with the following changes:
Amend rerevised bill, page 4, line 9, strike "years, but no grant for any one" and substitute "years.";
strike line 10;
line 11, strike "for any one year.".
Page 9, line 10, strike "2005." and substitute "2008.".
Page 10, line 26, strike "(36)" and substitute "(39) (b)".
Page 11, strike lines 1 through 9 and substitute the following:

"SECTION 5. Relationship to Senate Bill 00-071. (1) If both this act and Senate Bill 00-071 are enacted and become law, the provisions of both bills, including the appropriations contained therein, shall be given effect and harmonized except as follows:
(a) The introductory portion to 22-7-506 (3) (a) and 22-7-506 (5) (a), Colorado Revised Statutes, as enacted in this act shall supersede the provisions of the introductory portion to 22-7-506 (3) (a) and 22-7-506 (5) (a), Colorado Revised Statutes, as enacted in Senate Bill 00-071;
(b) 24-34-104 (36), Colorado Revised Statutes, as amended in Senate Bill 00-71, is amended to read:
24-34-104. General assembly review of regulatory agencies and functions for termination, continuation, or reestablishment. (36) The following agencies, functions, or both, shall terminate on July 1, 2005: The fire suppression program of the division of fire safety created pursuant to sections 24-33.5-1204.5, 24-33.5-1206.1, 24-33.5-1206.2, 24-33.5-1206.3, 24-33.5-1206.4, 24-33.5-1206.5, 24-33.5-1206.6, and 24-33.5-1207.6, C.R.S. and the read-to-achieve board created pursuant to section 22-7-506, C.R.S.
(c) 22-7-506 (4), Colorado Revised Statutes, as enacted in both this act and in Senate Bill 00-071 is REPEALED AND REENACTED, WITH AMENDMENTS, to read:
22-7-506. Read-to-achieve grant program - board created - fund. (4) (a) (I) There is hereby established in the state treasury the read-to-achieve cash fund, referred to in this section as the "cash fund". The cash fund shall consist of moneys appropriated thereto pursuant to paragraph (b) of this subsection (4) and any other moneys that may be made available by the general assembly. Subject to appropriation by the general assembly, moneys in the cash fund shall be used to provide grants to schools pursuant to this section. Any moneys not provided as grants to schools may be invested by the state treasurer as provided in section 24-36-113, C.R.S. All interest derived from the deposit and investment of moneys in the cash fund shall be credited to the cash fund. Any amount remaining in the cash fund at the end of any fiscal year shall remain in the cash fund and shall not be credited or transferred to the general fund or to any other fund.
(II) Up to one percent of the moneys in the cash fund may be used for the expenses incurred by the read-to-achieve board in administering this section. If the read-to-achieve board is unable to administer this program with existing personnel, the read-to-achieve board shall contract with private sources for such services.
(b) (I) Beginning with the 2000-01 fiscal year, and for each fiscal year thereafter so long as the state receives moneys pursuant to the master settlement agreement, the general assembly shall annually appropriate to the fund nineteen percent of the amount of moneys transmitted to the state treasurer in accordance with the master settlement agreement, other than attorney fees and costs, for the preceding fiscal year; except that the amount so appropriated to the fund in any fiscal year shall not exceed nineteen million dollars. The general assembly shall appropriate the amount specified in this paragraph (c) from moneys credited to the tobacco litigation settlement cash fund created in section 24-22-115, C.R.S.
(II) Notwithstanding the provisions of subparagraph (I) of this paragraph (b), for the fiscal year in which the first payment of moneys pursuant to the master settlement agreement is received, the percentage appropriated to the fund shall be calculated on the total amount of moneys received by the state pursuant to the master settlement agreement, other than attorney fees and costs, during that fiscal year, minus thirty-three million dollars.
(2) This section 5 shall take effect only if Senate Bill 00-071 is enacted and becomes law.".

CONSIDERATION OF RESOLUTION
HJR00-1042 by Representatives Paschall, King, May, and McKay; also Senators Evans, Andrews, Dennis, Musgrave, and Sullivant--Concerning a recommendation that the United States Congress amend the Clean Air Act pursuant to the report of the Environmental Protection Agency's Blue Ribbon Panel on Oxygenates in gasoline.

Amendment No. 1, moved by Representative Paschall.
Amend printed resolution, page 1, after line 16, insert the following:
"WHEREAS, There is limited research on the adverse health effects of MTBE; and
WHEREAS, Ethanol, the primary fuel sold along the Front Range, may be an ozone precursor and because of its biodegradability, increases the dispersion and persistence of benzene, toluene, ethyl benzene, and xylene (also known as "BTEX") around leaking tanks; and
WHEREAS, The report notes there is limited research on the adverse health effects of ethanol; and
WHEREAS, Other fuel oxygenates mandated under the Clean Air Act of 1990, including ethyl tertiary butyl ether ("ETBE"), tertiary amyl methyl ether ("TAME"), and di-iso propyl ether ("DIPE"), have received limited research on adverse health effects; and";
line 20, strike "all" and substitute "ALL".
