BUSINESS AFFAIRS AND LABOR
After consideration on the merits, the Committee recommends the following:
HB00-1088 be amended as follows, and as so amended, be referred to the Committee of the Whole with favorable recommendation:
Amend printed bill, page 1, line 9, strike "risk." and substitute "risk or insurance risk of loss.".
Page 2, line 7, strike the first "the" and substitute "the credit scoring";
line 12, strike "the credit report" and substitute "credit scoring information";
strike lines 15 through 17 and substitute the following:
“SECTION 3. Effective date: This act shall take effect January 1, 2000.
SECTION 4. Effective date: This act shall take effect at 12:01 a.m. on the day following the expiration of the ninety-day period after final adjournment of the general assembly that is allowed for submitting a referendum petition pursuant to article V, section 1 (3) of the state constitution; except that, if a referendum petition is filed against this act or an item, section or part of this act within such period, then the act, item, section, or part, if approved by the people, shall take effect on the date of the official declaration of the vote thereon by proclamation of the governor.”.

STATE, VETERANS AND MILITARY AFFAIRS
After consideration on the merits, the Committee recommends the following:
HB00-1095 be amended as follows, and as so amended, be referred to the Committee of the Whole with favorable recommendation:
Amend printed bill, page 14, line 11, after "signing.", insert "The registered elector, or the person printing on behalf of the registered elector, may use any abbreviations that reasonably identify the registered elector, the residence of the registered elector, and the date the registered elector signed the petition.".
Page 16, after line 1, insert the following:
"SECTION 15. 31-10-401, Colorado Revised Statutes, is amended to read:
31-10-401. Appointment of election judges. At least fifteen days before each municipal election, the governing body shall appoint the judges of election. Each judge of election shall be a registered an elector registered to vote in Colorado and shall be at least eighteen years of age. The clerk shall make and file in his office a list of all persons so appointed, giving their names, addresses, and precincts. Such list shall be a public record and shall be subject to inspection and examination during office hours by any qualified elector of the municipality with the right to make copies thereof. The governing body may by resolution delegate to the clerk the authority and responsibility to appoint judges of election.".
Renumber succeeding sections accordingly.
HB00-1096 be amended as follows, and as so amended, be referred to the Committee of the Whole with favorable recommendation:
Amend printed bill, page 3, line 9, strike "next" and substitute "twenty-first";
line 10, strike "decentralizes" and substitute "decentralizes, where appropriate,";
line 15, strike "designed" and substitute "designed, in part,";
line 19, strike "classification," and substitute "individual position allocation,";
line 26, strike "develop, in" and substitute "develop".

line 18, strike "agency." and substitute "agency and submitting to the personnel board a written statement describing any human resource innovation and management processes implemented by the agency. TRANSPORTATION AND ENERGY
After consideration on the merits, the Committee recommends the following:
HB00-1057 be amended as follows, and as so amended, be referred to the Committee of the Whole with favorable recommendation:
Amend printed bill, page 3, line 1, after "(II)", insert "(A)";
line 4, strike "infrastructure and" and substitute "infrastructure,";
line 7, strike "highway. If" and substitute "highway, and the authority and the Colorado department of transportation have executed an intergovernmental agreement that specifies the circumstances under which the construction of an above-grade or below-grade intersection is required and the entity responsible for payment of construction costs to build such intersection.
(B) If";
line 11, after "by", insert "sub-subparagraph (A) of".
HB00-1069 be referred to the Committee on Appropriations with favorable recommendation.
HB00-1131 be amended as follows, and as so amended, be referred to the Committee on Finance with favorable recommendation:
Amend printed bill, page 1, strike lines 2 through 8 and substitute the following:
"SECTION 1. 42-4-237 (2) and (5), Colorado Revised Statutes, are amended to read:
42-4-237. Safety belt systems - mandatory use - exemptions - penalty. (2) Unless exempted pursuant to subsection (3) of this section, every driver of and every front seat passenger in a motor vehicle equipped with a safety belt system shall wear a fastened safety belt while the motor vehicle is being operated on a street or highway in this state. The failure of a driver of, or a passenger in, a motor vehicle to wear a fastened safety belt alone shall not constitute probable cause for a law enforcement officer to arrest the driver or passenger or to conduct a search of a motor vehicle, its contents, the driver, or any passenger.
(5) No driver in a motor vehicle shall be cited for a violation of subsection (2) of this section unless such driver was stopped by a law enforcement officer for an alleged violation of articles 1 to 4 of this title other than a violation of this section.".______________
INTRODUCTION OF RESOLUTION
The following resolution was read by title and referred to the committee indicated:
HJR00-1003 by Representatives McPherson, Tool, Berry, Saliman; also Senators Teck, Lacy, Owen, Tanner--Concerning the certification by the general assembly of its estimate of state general fund revenues and allowable state general fund appropriations for the 2000-01 budget year.
Committee on Finance
WHEREAS, The general assembly is required by section 24-75-201.3, Colorado Revised Statutes, to make an annual certification of its estimate of general fund revenues for the next fiscal year to the controller; and
WHEREAS, Gross general fund revenues for the 2000-01 fiscal year, as estimated in this resolution, have already been obligated by law as follows:
(1) $100,746,148 for transfer to the capital construction fund pursuant to section 24-75-302 (2) (m), Colorado Revised Statutes;
(2) Amounts required by statute to be used for: Payments to local governments based on state cigarette tax collections; property tax and heat or fuel expense grants; and payments to the fire and police members' benefit fund; and
WHEREAS, Under current law, general fund revenues must be used first to fund the obligations set forth above, second to fund appropriations for the executive, legislative, and judicial departments, and third to fund the reserve mandated by section 24-75-201.1 (1) (d), Colorado Revised Statutes; and
WHEREAS, The general assembly recognizes that new programs can be funded from the general fund only after these three priorities are satisfied; and
WHEREAS, If appropriate statutes are amended, additional general fund revenues could be realized; and
WHEREAS, The estimate of general fund revenues certified in this resolution does not include the balance carried forward from the 1999-2000 fiscal year; and
WHEREAS, The general assembly intends to make an annual certification of its estimate of the total allowable state general fund appropriations under section 24-75-201.1, Colorado Revised Statutes; and
WHEREAS, In accordance with the provisions of section 24-75-201.1, Colorado Revised Statutes, the estimate of the allowable state general fund appropriations for the 2000-01 fiscal year will be based upon the following conclusions:
(1) State general fund appropriations for the 1999-2000 fiscal year, prior to the enactment of any supplemental appropriations during the 2000 regular session, are $4,989.0 million;
(2) The allowable increase in state general fund appropriations for the 2000-01 fiscal year is the cost of reappraisal of taxable property for property tax purposes as required by section 39-1-105.5, Colorado Revised Statutes, plus 6% of the 1999-2000 state general fund appropriations; and
WHEREAS, The revenue estimate and the estimate of allowable state general fund appropriations made pursuant to this resolution are made for the purpose of providing direction and guidance to the joint budget committee in the preparation of the 2000-01 general appropriation act and does not affect the ability of the general assembly to make spending decisions in the general appropriation act; and
WHEREAS, The revenue estimate and the estimate of allowable state general fund appropriations made pursuant to this resolution may be adjusted if additional relevant information is received by the general assembly after the adoption thereof; and
WHEREAS, For purposes of section 39 of article V of the state constitution, this resolution relates solely to the transaction of business of the two houses of the general assembly; now, therefore,
Be It Resolved by the House of Representatives of the Sixty-second General Assembly of the State of Colorado, the Senate concurring herein:
That, in accordance with section 24-75-201.3, Colorado Revised Statutes, the general assembly hereby certifies to the controller of the state of Colorado that the estimate of gross general fund revenues for the fiscal year beginning July 1, 2000, is $6,519.1 million. The general assembly further certifies that the estimate of the allowable state general fund appropriations for the fiscal year beginning July 1, 2000, under section 24-75-201.1, Colorado Revised Statutes, is $5,288.3 million.
Be It Further Resolved, That a copy of this Resolution be transmitted to the controller of the state of Colorado, Arthur L. Barnhart. _______________

Amend the State, Veterans, & Military Affairs Committee Report, dated January 11, 2000, page 1, strike lines 1 through 3, and substitute the following:
"Amend printed bill, page 2, strike lines 1 through 20, and substitute the following:
"2-3-303.3. Interim studies. The legislative council shall meet during the regular session each year for the purpose of making recommendations, in the form of a joint resolution, of reviewing and prioritizing bills and joint resolutions that create or authorize any studies to be conducted during the interim or that allocate any additional legislative staff resources during the interim. If, the study resolution is not adopted by the end of the regular session, After the general assembly has adjourned, if issues are brought to the attention of the executive committee of the legislative council and the executive committee determines that the issues are appropriate for being addressed by an interim study and are the result of changed circumstances or new circumstances, the executive committee of the legislative council shall determine the interim studies and shall may provide for the conduct of such additional interim studies by adopting a resolution. adopted by the executive committee no later than the first Monday in June.".".

Amend printed bill, page 3, strike line 23 and substitute the following:
"SECTION 4. 43-2-145 (1) and (2), Colorado Revised Statutes, are".
Page 5, after line 4, insert the following:
"(2) The committee shall be comprised of eleven members to be selected as follows:
(a) Five members appointed by the governor from such highway advisory groups as the governor shall select, but which members shall be determined by him to adequately represent the entire state, no more than three of whom shall be from the same political party;
(b) Three The members of the transportation and energy committee of reference of the house of representatives; appointed by the speaker of the house of representatives, no more than two of whom shall be from the same political party;
(c) Three The members of the transportation committee of reference of the senate. appointed by the president of the senate, no more than two of whom shall be from the same political party.".
Amendment No. 4, by Representative Paschall.
Amend the Amendment No. 3, by Representative Gotlieb, printed in House Journal January 17, page 101, strike lines 1 through 4 and substitute the following:
"(a) Five members appointed by the governor from such highway advisory groups as the governor shall select, but which members shall be determined by him to adequately represent the entire state, no more than three of whom shall be from the same political party;".
