House of Representatives, be appointed by the President of the Senate and the Speaker of
the House of Representatives, respectively, to notify His Excellency, Governor Bill Owens, that the Second Regular Session of the Sixty-second General Assembly of the State of Colorado is organized and ready for the transaction of business.

WELCOME TO THE NEW CENTURY.
WELCOME TO THE FIRST LEGISLATIVE SESSION OF THE NEW MILLENNIUM.
I NEVER THOUGHT MUCH ABOUT USHERING IN A NEW CENTURY, BUT I AM BOTH PROUD AND HUMBLED TO STAND HERE AS LEADER OF THIS HISTORIC BODY. BECAUSE THIS IS A NEW BEGINNING, WE NEED TO FULLY UNDERSTAND WHERE WE CAME FROM IN ORDER TO MORE FULLY APPRECIATE THE OPPORTUNITIES BEFORE US.
THE LAST TIME A CENTURY TURNED, THE UNITED STATES HAD:
.ONE FOURTH OF THE POPULATION OF TODAY, 76 MILLION
.NO ONE HAD EVER FLOWN
.TELEVISION AND COMPUTERS WERE THE STUFF OF FICTION
.THE LIFE EXPECTANCY OF MEN AND WOMEN WERE 46 AND 48 - .TODAY MEN LIVE TO AN AVERAGE AGE OF 74, AND WOMEN TO 79
.ON DECEMBER 17TH, 1903 THE WRIGHT BROTHERS FIRST FLIGHT TRAVELED 120 FEET IN 12 SECONDS.
TODAY, COMMERCIAL AIRLINES CARRY OVER 614 MILLION PEOPLE THOUSANDS OF MILES.
IN 1900 THE AVERAGE HOUSEHOLD SIZE CONSISTED OF 4.8 PEOPLE. IN 1998 THE AVERAGE HOUSEHOLD SIZE WAS 2.6 PEOPLE.
THE UNITED STATES GOVERNMENT COLLECTED $ 567 MILLION DOLLARS IN 1900. LAST YEAR COLORADO COLLECTED OVER $ 11 BILLION, OR ABOUT 20 TIMES THE 1900 AMOUNT. IN 1999 THE FEDERAL GOVERNMENT TOOK IN $ 1.7 TRILLION DOLLARS.
DURING THIS CENTURY MANY INNOVATIONS HAVE COMBINED TO MAKE OUR NATION AND THE QUALITY OF LIFE OUR PEOPLE ENJOY THE ENVY OF THE REST OF THE WORLD. THESE INCLUDE BUT ARE NOT LIMITED TO:
1.RADIO AND TELEVISION
2.COMPUTERS
3.TRANSPORTATION
4.IMPROVEMENTS IN MEDICAL CARE
5.SOCIAL SECURITY
6.STATE AND FEDERAL GOVERNMENT SAFETY NETS
7.THE PROFUSION OF CONSUMER ORIENTED PRODUCTS AND SERVICES.
NOW....TO THE PRESENT, AND MORE IMPORTANTLY, TO THE FUTURE. YOU AND I, AND OUR COLLEAGUES IN THE HOUSE OF REPRESENTATIVES WILL BE DEALING WITH MANY COMPLEX AND DIFFICULT ISSUES OVER THE NEXT 120 DAYS THAT WILL AFFECT THE QUALITY OF LIFE FOR ALL COLORADANS. LET ME LIST JUST A FEW:
THE ISSUE OF GUNS CONTINUES TO RESONATE. GOVERNOR OWENS HAS PUT HIS PLAN ON THE TABLE, AS HAVE A NUMBER OF THE MEMBERS OF THE HOUSE AND SENATE.
I DON'T KNOW WHAT THE OUTCOME WILL BE, BUT I DO KNOW THAT WE WILL HAVE A SPIRITED DEBATE. HOUSE SPEAKER RUSSELL GEORGE AND I ARE COMMITTED TO FINISH THE DEBATE AND ACTION ON THIS ISSUE OF GUNS BY THE MIDDLE OF FEBRUARY, SO THAT WE CAN MOVE ON TO A VARIETY OF OTHER SUBJECTS THAT ALSO DESERVE OUR ATTENTION.
ONE SUCH ISSUE IS THE DEBATE OVER GROWTH IN COLORADO. THERE WILL BE MANY BILLS DEALING WITH THIS SUBJECT, BUT THERE WILL BE MANY DIFFERENT POINTS OF VIEW EXPRESSED.
MY OWN POINT OF VIEW IS THAT WHATEVER BILL OR BILLS PASS, WE MUST REMEMBER THAT ONE PLAN DOES NOT FIT ALL.....AND WE MUST BALANCE PRIVATE PROPERTY RIGHTS WITH LAND USE RESTRICTIONS. AND ABOVE ALL, WE MUST NOT PENALIZE FARMERS AND RANCHERS WHO OWN LAND CLOSE TO OUR GROWING CITIES AND TOWNS. WE NEED INCENTIVES TO KEEP FARMERS AND RANCHERS ON THE LAND. I HAVE ALWAYS BELIEVED THAT LAND USE DECISIONS ARE LOCAL DECISIONS, NOT STATE MANDATES.
THE CITIES AND COUNTIES ARE PROPOSING THE USE OF INTERGOVERNMENTAL AGREEMENTS TO KEEP THESE DECISIONS AT THE LOCAL LEVEL WHERE THEY BELONG. THIS MAY BE A VEHICLE THAT CAN BECOME ONE OF THE CORNERSTONES OF AN AGREEMENT ON THE MANAGEMENT OF GROWTH IN THE NEW CENTURY.
PUBLIC EDUCATION CONTINUES TO HOLD CENTER STAGE IN THE NEW YEAR. GOVERNOR OWENS HAS LAID OUT AN AMBITIOUS PLAN TO IMPROVE OUR SCHOOLS, AND HAS IDENTIFIED THE DOLLARS TO MAKE THIS HAPPEN.
MANY OF YOU HAVE YOUR OWN IDEAS, AND ALL WILL BE CONSIDERED. WE MUST SERIOUSLY ADDRESS THE FUNDING FOR THE IMPROVEMENT OF K-12 EDUCATION, AS WELL AS ADDRESSING THE EVENTUAL DECISION THAT WILL COME FROM A COURT CHALLENGE DEALING WITH THE STATE'S FUNDING RESPONSIBILITIES FOR LOCAL SCHOOL BUILDING CONSTRUCTION.
ONE ISSUE THAT HAS NOT RECEIVED MUCH PUBLIC DISCUSSION IS THE ISSUE OF WORKFORCE DEVELOPMENT, INCLUDING EDUCATION AND TRAINING.
PERHAPS WE NEED MORE EMPHASIS FROM HIGHER EDUCATION AS WELL AS THE POSSIBILITY OF INCENTIVES TO THE PRIVATE SECTOR FOR JOB TRAINING.
THE INITIAL PAYMENT OF THE TOBACCO SETTLEMENT IS NOW IN OUR TRUST ACCOUNT. THIS LEGISLATURE NEEDS TO PASS A BILL TO DEAL WITH THESE DOLLARS AND THE ISSUES THEY WILL IMPACT. THERE ARE MANY IDEAS AS TO HOW AND WHAT TO SPEND THE DOLLARS ON, INCLUDING PUBLIC HEALTH, THE GOVERNOR'S "READ TO ACHIEVE" PROGRAM FOR THIRD GRADERS;
CAPITAL CONSTRUCTION FOR LOCAL SCHOOL DISTRICTS; AND INVESTMENT OF THE PRINCIPLE IN THE TRUST FUND. OUR STATE TREASURER HAS A PLAN TO SELL THE ASSET AND BANK THE PROCEEDS FOR THE BENEFIT OF ALL OUR CITIZENS. THIS DISCUSSION WILL ALSO BE VERY LIVELY.
HIGHWAYS REMAIN HIGH ON THE STATE'S RADAR SCREEN. YES....THE BONDS DID PASS FOR 24 HIGHWAY PROJECTS AND LIGHT RAIL.......BUT THAT DOESN'T SOLVE THE PROBLEM. IT MOVES UP THE COMPLETION DATES FOR THOSE 24 PROJECTS, BUT ADDITIONAL DOLLARS ARE NEEDED.
OTHER TRANSPORTATION ISSUES INCLUDE WHETHER OR NOT THE STATE OF COLORADO WILL YIELD TO THE FEDERAL GOVERNMENT IN AREAS SUCH AS OPEN CONTAINERS, SEAT BELTS AND LOWERING BLOOD ALCOHOL LEVELS.
GOVERNOR OWENS HAS PROPOSED AN ADDITIONAL $ 50 MILLION PER YEAR FOR OUR HIGHWAYS.
ANOTHER BILL IN THE HOPPER PROPOSES ADDING $ 15 MILLION PER YEAR UNTIL IT REACHES $ 200 MILLION FOR THE HIGHWAY USERS TRUST FUND.
IT IS TIME FOR THE LEGISLATURE TO CONSIDER NOT ONLY PROBLEMS ALONG THE MAJOR CORRIDORS, BUT ALSO THE PRESSING NEEDS THROUGHOUT THE REST OF COLORADO, INCLUDING THE NEEDS WITHIN OUR CITIES AND COUNTIES FOR ADDITIONAL HIGHWAYS AND HIGHWAY DOLLARS.
AND OF COURSE, WE WILL HAVE A NUMBER OF BILLS FOR TAX REDUCTION, TAX RATE REDUCTION, RETURNING THE TABOR SURPLUS, ETC.
GOVERNOR OWENS BELIEVES WE NEED OVER $ 100 MILLION IN PERMANENT TAX REDUCTIONS AGAIN THIS YEAR. AND, SINCE THE NEW REVENUE PROJECTIONS, HE HAS INDICATED THAT WE NEED TO CUT ADDITIONAL TAXES.
AND WHAT OF THE NEW TECHNOLOGIES THAT CONFRONT OUR CITIZENS EVERY DAY. VISIONARIES PREDICT THAT BUYING ON THE INTERNET WILL INCREASE DRAMATICALLY. WHAT DOES THIS DO TO THE BUSINESS CYCLE IN COLORADO, AND WHAT WILL ITS EFFECT ON TAX COLLECTIONS BE?
DO WE TAX INTERNET SALES? CAN WE TAX INTERNET SALES? WE HAVE A MAJOR ROADBLOCK HERE. AT THE MOMENT, CONGRESS HAS A MORATORIUM ON THE TAXATION OF INTERNET SALES. IN LIGHT OF UNCERTAIN TRENDS DO WE CONTINUE TO PERMANENTLY REDUCE TAXES WITHOUT DEALING WITH THIS SUBJECT? AND THEN, OF COURSE, WE HAVE THE TABOR AMENDMENT TO DEAL WITH.
THIS WILL BE A VERY DIFFICULT YEAR BECAUSE OF ALL THE PRIORITIES AND ISSUES THAT WILL NEED TO BE ADDRESSED. IN ROUND NUMBERS, THE LEGISLATURE WILL HAVE APPROXIMATELY $ 300 MILLION IN NEW MONEY.....BUT FAR MORE REQUESTS THAN DOLLARS. AS I HAVE SAID BEFORE, I'M GLAD WE HAVE GOOD MEMBERS ON THE JOINT BUDGET COMMITTEE AND THE FINANCE COMMITTEE.
AND THERE ARE OTHER ISSUES, LIKE THE AGING OF AMERICA. IN THE NOT TOO DISTANT FUTURE, COLORADO WILL HAVE MORE ELDERLY POPULATION NEEDS....THAN CHILDHOOD NEEDS. THIS WILL BE A MAJOR LIFESTYLE CHANGE FOR US TO DEAL WITH.
ANOTHER INTERESTING CHANGE IS THAT THE "OZZIE & HARRIET" FAMILY MODEL WE KNEW IN THE 1950'S ..... NOW COMPRISES ONLY 7.5 PERCENT OF OUR AMERICAN FAMILIES.
AND THEN THERE ARE HISTORICAL MODELS TO LOOK AT AND EXAMINE. LET ME QUOTE FROM A WORK BY EDWARD GIBBON THAT MAY DEAL WITH SOME ISSUES THAT SOUND SOMEWHAT FAMILIAR.
"THE CRUEL ABSURDITY OF THE PRINCES, UNABLE TO PROTECT THEIR SUBJECTS AGAINST THE PUBLIC ENEMY, UNWILLING TO TRUST THEM WITH ARMS FOR THEIR OWN DEFENSE; THE INTOLERABLE WEIGHT OF TAXES, RENDERED STILL MORE OPPRESSIVE BY THE INTRICATE OR ARBITRARY MODES OF COLLECTION;
THE OBSCURITY OF NUMEROUS AND CONTRADICTORY LAWS; THE TEDIOUS AND EXPENSIVE FORMS OF JUDICIAL PROCEEDINGS; THE PARTIAL ADMINISTRATION OF JUSTICE.
EDWARD GIBBON WROTE THAT IN HIS BOOK ENTITLED, "THE DECLINE AND FALL OF THE ROMAN EMPIRE."
IN THE REAL WORLD....PERCEPTION BECOMES REALITY. HOWEVER, IN OUR WORLD OF POLITICS.....PERCEPTION IS REALITY. WITH THIS IN MIND I RECENTLY READ SOME MATERIAL PUT TOGETHER BY THE UNIVERSITY OF COLORADO GRADUATE SCHOOL OF PUBLIC AFFAIRS.
SOME OF THEIR FINDINGS OR PERCEPTIONS ARE TROUBLING. AFTER A RECENT LEGISLATIVE LEADERSHIP FORUM HELD IN COLORADO SPRINGS, A NUMBER OF CONCERNS SURFACED:
THE LEGISLATURE IS INEFFICIENT BY DESIGN, YET THE TIMES REQUIRE NIMBLE ACTION.
MEMBERS APPARENTLY PUT MUCH LESS STOCK ON "KEEPING THEIR WORD," THUS ERODING A VALUED INSTITUTIONAL NORM.
TERM LIMITS SHORTENS INSTITUTIONAL MEMORY.
THERE IS AN INCREASED TENDENCY FOR MEMBERS TO "TRASH OUR INSTITUTION." THIS ERODES INSTITUTIONAL PRESTIGE.
THE CULTURE OF THE SENATE IS CHANGING. IT IS BECOMING ALMOST INDISTINGUISHABLE FROM THAT OF THE HOUSE OF REPRESENTATIVES.
THE GENERAL ASSEMBLY NOW PLAYS A LESS IMPORTANT ROLE DUE TO THE INCREASED USE OF THE INITIATIVE AND REFERENDUM PROCESSES.
THOUGHT PROVOKING IS IT NOT? IS THIS HOW WE VIEW OUR OWN INSTITUTION? IS THIS HOW WE WANT THE PUBLIC TO PERCEIVE US?
I CONGRATULATE GOVERNOR OWENS ON THE ACCOMPLISHMENTS OF HIS ADMINISTRATION DURING HIS FIRST YEAR IN OFFICE. I PLEDGE TO CONTINUE TO WORK WITH GOVERNOR OWENS AND HIS ADMINISTRATION, AND WITH SPEAKER RUSSELL GEORGE AND THE HOUSE OF REPRESENTATIVES.......AND ALL OF OUR STATE SENATORS.
I HOPE WE CAN WORK CONSTRUCTIVELY THIS SESSION WITH A MINIMUM OF POLITICAL RANCOR AND DEMAGOGUERY, DESPITE THE FACT THAT THIS IS AN ELECTION YEAR. MY DOOR WILL ALWAYS BE OPEN, AND I BELIEVE WE CAN SERVE THE CITIZENS OF COLORADO BEST IF WE ARE WILLING TO WORK TOGETHER AND SHARE IDEAS AND CREDIT.
LET ME LEAVE YOU WITH ONE SIMPLE THOUGHT. I RECENTLY VISITED THE GRAVESITE OF ONE OF THE EARLY COLORADO SPRINGS PIONEERS. ON WINFIELD STRATTON'S GRAVE WAS INSCRIBED THIS THOUGHT, AND I PARAPHRASE:
"IT IS NOT ENOUGH TO HELP THE PEOPLE UP, BUT TO SUPPORT THE PEOPLE AFTER." THIS IS OUR TASK FOR THE LEGISLATIVE SESSION, AND THESE ARE WORDS TO LIVE BY.

On motion of Senator Blickensderfer, and with the unanimous consent of those elected to the Senate, the Senate stood in recess to hear the opening day remarks of Senate Minority Leader Michael Feeley. The text of Senator Feeley's remarks follow.
Mr. President, members of the Senate, senate staff and guests - good morning. It is a pleasure to see all of you this morning. Like many members here this morning, I am about to start my last legislative session. This is the sixth time and the last time I have the privilege to address the senate on opening day. Writing these speeches each year has been an interesting undertaking. I'm sure the President and the Speaker have had similar experiences - sometimes we actually get lobbied about what to include in an opening day speech. More often than not, the speeches recite a litany of the big anticipated issues we are likely to face - there is sort of a formula to them. When the senate convened in 1900, the major issues they faced were schools and roads. One hundred years later, the big issues we face are schools and roads - and I could talk about them. But I thought I'd talk briefly about a few of the issues that we never seem to get our hands on - issues that are tough, and that we are unable or unwilling to address.
Over the past decade I believe we have seen a threat to our system of representative democracy in Colorado. I have had numerous conversations with Representative Bill Kaufman who has publically spoken about he risk of losing that representative form of government. The threat comes from the initiative process. Let me be thorough not the process itself, but the willingness of some to abuse the essential tool incorporated into our state constitutional.
In 1787, when the framers of the federal constitution met in Philadelphia, they discussed whether we as a nation would best be served by a representative democracy or direct democracy. They debated a form of government where public decisions would be made by elected representatives of the people or one where every issue, large or small, would be decided directly by every citizen. For many good reasons they concluded that a representative democracy was the far more preferable form of government.
But look what we have done to our representative democracy in recent years. In 1992, we passed an incredibly complex tax payer bill-of-rights, the implications of which we are still discovering. In 1998, every citizen was asked to make a decision concerning the geology and hydrology of the San Luis Valley. Each voter was also asked to decide between competing forms of large scale hog farm operations. In 1995, San Francisco voters faced a ballot 235 pages long. As of this morning, in Colorado there have been 253 ballot proposals submitted, more than half of them submitted by a single individual.
Every decision by plebiscite lacks the important features a deliberative legislative body can bring to an issue. With an initiative there is no opportunity to modify and amend a proposal - there is no opportunity for compromise - and it is presented on an all or nothing, take it or leave it basis.
When the drafters in Philadelphia considered the question, they concluded that representative democracy was essential to the critical balance of our constitutional government. Alexander Hamilton noted:
The danger of disturbing the public tranquility by interesting too strongly the public passions is a still more serious objection against a frequent reference of constitutional questions to the decision of the whole society...But the greatest objection of all is, that the decisions which would probably result from such appeals would not answer the purpose of maintaining the constitutional equilibrium of the government.
The framers were careful and thoughtful. The constitution they built anticipated unforseen circumstances. We are in danger of replacing the thinking of Alexander Hamilton, James Madison, James Monroe and George Washington with one guy named Doug Bruce. Frankly, I don't think that is much of a bargain.
Some of the initiative proposals have great street appeal and look good on a bumper sticker. But slick media campaigns funded by special interests are no substitute for representative democracy. We have been granted the responsibility to make public decisions. We enjoy or suffer the consequences of those decisions and it is our obligation to maintain a constitution that is the best in the world.
One issue we never address is comprehensive tax policy. In part, it is a problem because of the initiatives we have passed. Rumors have it that there are more than 100 tax bills in the hopper. Now, I am sure that many of them are good, thoughtful proposals and I know that each of them are important to someone. But, haven’t we spent enough time piecing together a tax policy without any long term comprehensive plan. This past November, we asked the voters for permission to go out and borrow money secured by federal tax dollars we have not yet received. At the same time we are figuring out ways to return state tax dollars we already have. It makes you wonder who is in charge, but then you realize that we’re in charge. We asked to be in-charge and our constituents said okay. Will we ever deal with the Gallagher Amendment? Is there to much local government reliance upon sales taxes? Will internet sales, which are not taxed, hurt Colorado main street business? Do we have a reliable source of funds for our children’s education, for our highways, for our prisons? These are some fundamental questions we never grapple with, because we deal with the easier questions, about eliminating this tax or that tax. I have worked on this issue for a number of years. Senator Teck has championed comprehensive planning. Senator Norton did in the past. The Senate has passed legislation trying to get a handle on our complex tax system. Hopefully this year we will be able to convince our colleagues in the House that we should step back and take a long term view of our fiscal policy.
Finally this is my last opportunity to talk about yet another initiative that affects all of us and that is term limits. When I came to the legislature in the 1993 session, I was privileged to serve among people who I consider giants, Al Meiklejohn, Regis Groff, Claire Traylor and some others. These were public servants, who took their legislative responsibilities very seriously and over long tenures contributed in so many different ways to the people in Colorado. There are some giants here among us, but because of term limits, in many cases we may never know who they are. We won’t know that because their time will be up.
Over the past seven years, I have seen some courageous acts in this room. Like all of us, I have tried to become a student of the Colorado State Senate. One of the friends I have made in the past few years is Lyle Kyle. For those of you who don't know Lyle, he was the Director of Legislative Council for almost thirty years. He is a walking encyclopedia of the history of this Senate. This summer I heard Lyle tell a story about what I thought was the best of the Senate.
In 1959, after several years of discussion, planning and arguing the last comprehensive tax proposal this state enacted, Governor Steve McNichols tax package, came before the Senate. The opposition was led by Senator Ted Gill. Senator Gill was from Hillrose, Colorado in Morgan County - he was a very conservative Republican legislator. He served for 20 years. The senator who carried the bill was the majority leader, Senator Jim Mobry, a Democrat from Delta County. That's right Senator Chlouber - I said the majority leader was a Democrat. I just saw Senator Chlouber wince - but that's OK he'll get used to it.
As Lyle described it, Senator Gill and Senator Mobry had fought "tooth and toenail" all session and the votes were very close. There was a constitutional time limit in effect at the time and the bill had not yet passed. They were down to the last few days of the session. Unfortunately, then, Senator Mobry's father passed away . The family scheduled the service, but because the votes were so close and time was so short, Senator Mobry couldn't leave for Delta to attend his father's funeral. But then, Senator Gill, who had fought with all of his resources to defeat this measure walked to the microphone, right where I am standing now and told the members that he had a conversation with Jim Mobry, and that he had made a commitment to him. He said that he thought that Senator Mobry should be at his father’s funeral and he thought that most of the members felt that way too. And if the tax bill came up and Senator Mobry was not there to cast the vote in favor of that bill - that he would. He was good to his word, the bill passed and was signed into law. Do you think that could happen today?
Of course, this process is about issues and about policy. But I believe it is more about integrity more about respect for our differences more about respect for one another.
We are all blessed with having had the chance to serve in this Senate. We have a proud tradition to maintain and we should all set high standards of ourselves. This year I hope we all strive to reach the standards set by Senator Gill and other who have served before us. In this era of term limits it is up to us to set the standard for those who serve when our time is done.
I wish us all the best of luck this year and all the best for the citizens of this great state. _______________________

The following concurrent resolution was read by title and referred to the committee indicated:
SCR 00-001 by Senators Congrove and Sullivant; also Representative Witwer--Concerning the
submission to the registered electors of the state of Colorado of an amendment to
section 3 (1)(b) of article X of the constitution of the state of Colorado, requiring
the same ratio of valuation for assessment that is applied to residential real property
for the purpose of imposing property tax to be applied to vacant land.
