BILL

To the President of the Senate and the
Speaker of the House of Representatives:
Your first conference committee appointed on HB00-1227, concerning revenue from annual motor vehicle registrations, and making an appropriation in connection therewith, has met and reports that it has agreed upon the following:
1. That the House accede to the Senate amendments made to the bill, as said amendments appear in the rerevised bill, with the following change:
Amend rerevised bill, page 20, line 26, strike "seventy" and substitute "thirty".
2. That, under the authority granted the committee to consider matters not at issue between the two houses, the following amendments be recommended:
Amend rerevised bill, page 18, line 25, strike "(I) (A)," and substitute "(I),";
line 26, after "amended", insert "BY THE ADDITION OF A NEW SUB-SUBPARAGRAPH".
Page 19, strike lines 1 through 9 and substitute the following:
"39-26-123. Receipts - disposition. (2) (a) (I) (A.5) Notwithstanding sub-subparagraph (A) of this subparagraph (I),".
Page 20, line 16, after "(2)", insert "(a)";
line 26, change the period to a comma and add "as adjusted pursuant to paragraph (b) of this subsection (2).";
after line 26, insert the following:
"(b) (I) No later than October 1 of any given calendar year commencing on Senate Journal-120th Day-May 3, 2000 Page 1

or after January 1, 2001, the executive director of the department of revenue shall annually adjust the dollar amount specified in paragraph (a) of this subsection (2) to reflect the rate of growth of Colorado personal income for the calendar year immediately preceding the calendar year in which such adjustment is made. For purposes of this subparagraph (I), "the rate of growth of Colorado personal income" means the percentage change between the most recent published annual estimate of total personal income for Colorado, as defined and officially reported by the bureau of economic analysis in the United States department of commerce for the calendar year immediately preceding the calendar year in which the adjustment is made and the most recent published annual estimate of total personal income for Colorado, as defined and officially reported by the bureau of economic analysis in the United States department of commerce for the calendar year prior to the calendar year immediately preceding the calendar year in which the adjustment is made.
(II) Upon calculating the adjustment of said dollar amount in accordance with subparagraph (I) of this paragraph (b), the executive director shall notify in writing the executive committee of the legislative council created pursuant to section 2-3-301 (1), C.R.S., of the adjusted dollar amount and the basis for the adjustment. Such written notification shall be given within five working days after such calculation is completed, but such written notification shall be given no later than October 1 of the calendar year.
(III) It is the function of the executive committee of the legislative council to review and approve or disapprove such adjustment of said dollar amount within twenty days after receipt of such written notification from the executive director. Any adjustment that is not approved or disapproved by the executive committee within said twenty days shall be automatically approved; except that, if within said twenty days the executive committee schedules a hearing on such adjustment, such automatic approval shall not occur unless the executive committee does not approve or disapprove such adjustment after the conclusion of such hearing. Any hearing conducted by the executive committee pursuant to this subparagraph (III) shall be concluded no later than twenty-five days after receipt of such written notification from the executive director.
(IV) (A) If the executive committee of the legislative council disapproves any adjustment of said dollar amount calculated by the executive director pursuant to this paragraph (b), the executive committee shall specify such adjusted dollar amount to be utilized by the executive director. Any adjusted dollar amount specified by the executive committee pursuant to this sub-subparagraph (A) shall be calculated in accordance with the provisions of this paragraph (b).
(B) For the purpose of determining whether the reduction in vehicle registration fees pursuant to house bill 00-1227, enacted at the second regular session of the sixty-second general assembly, is to be implemented for any given fiscal year, the executive director shall not utilize any adjusted dollar amount that has not been approved pursuant to subparagraph (III) of this paragraph (b) or otherwise specified pursuant to sub-subparagraph (A) of this subparagraph (IV).
(V) If one or more ballot questions are submitted to the voters at a statewide election to be held in November of any calendar year commencing on or after January 1, 2001, that seek authorization for the state to retain and spend all or any portion of the amount of excess state revenues for the state fiscal year ending during said calendar year, the executive director shall not determine whether the reduction in vehicle registration fees pursuant to house bill 00-1227, enacted at the second regular session of the sixty-second general assembly, shall be implemented and shall not promulgate rules containing said reductions until the impact of the results of said election on the amount of the excess state revenues to be refunded is ascertained.".

Your first conference committee appointed on HB00-1259, concerning the reduction of the state sales and use tax rate, and making an appropriation in connection therewith, has met and reports that it has agreed upon the following:
That the House accede to the Senate amendments made to the bill, as said amendments appear in the rerevised bill, with the following changes:

"(b) (I) No later than October 1 of any given calendar year commencing on or after January 1, 2001, the executive director shall annually adjust the dollar amount specified in paragraph (a) of this subsection (3) to reflect the rate of growth of Colorado personal income for the calendar year immediately preceding the calendar year in which such adjustment is made. For purposes of this subparagraph (I), "the rate of growth of Colorado personal income" means the percentage change between the most recent published annual estimate of total personal income for Colorado, as defined and officially reported by the bureau of economic analysis in the United States department of commerce for the calendar year immediately preceding the calendar year in which the adjustment is made and the most recent published annual estimate of total personal income for Colorado, as defined and officially reported by the bureau of economic analysis in the United States department of commerce for the calendar year prior to the calendar year immediately preceding the calendar year in which the adjustment is made.
(II) Upon calculating the adjustment of said dollar amount in accordance with subparagraph (I) of this paragraph (b), the executive director shall notify in writing the executive committee of the legislative council created pursuant to section 2-3-301 (1), C.R.S., of the adjusted dollar amount and the basis for the adjustment. Such written notification shall be given within five working days after such calculation is completed, but such written notification shall be given no later than October 1 of the calendar year.
(III) It is the function of the executive committee of the legislative council to review and approve or disapprove such adjustment of said dollar amount within twenty days after receipt of such written notification from the executive director. Any adjustment that is not approved or disapproved by the executive committee within said twenty days shall be automatically approved; except that, if within said twenty days the executive committee schedules a hearing on such adjustment, such automatic approval shall not occur unless the executive committee does not approve or disapprove such adjustment after the conclusion of such hearing. Any hearing conducted by the executive committee pursuant to this subparagraph (III) shall be concluded no later than twenty-five days after receipt of such written notification from the executive director.
(IV) (A) If the executive committee of the legislative council disapproves any adjustment of said dollar amount calculated by the executive director pursuant to this paragraph (b), the executive committee shall specify such adjusted dollar amount to be utilized by the executive director. Any adjusted dollar amount specified by the executive committee pursuant to this sub-subparagraph (A) shall be calculated in accordance with the provisions of this paragraph (b).
(B) For the purpose of determining whether the sales tax rate reduction authorized by paragraph (a) of this subsection (3) is to be allowed for any given income tax year, the executive director shall not utilize any adjusted dollar amount that has not been approved pursuant to subparagraph (III) of this paragraph (b) or otherwise specified pursuant to sub-subparagraph (A) of this subparagraph (IV).
(V) If one or more ballot questions are submitted to the voters at a statewide election to be held in November of any calendar year commencing on or after January 1, 2001, that seek authorization for the state to retain and spend all or any portion of the amount of excess state revenues for the state fiscal year ending during said calendar year, the executive director shall not determine whether the sales tax rate reduction authorized by paragraph (a) of this subsection (3) shall be allowed and shall not promulgate rules containing said sales tax rate reduction until the impact of the results of said election on the amount of the excess state revenues to be refunded is ascertained.";

The House has rejected the First report of the First conference committee on SB00- 049 and has voted to dissolve the First conference committee and requests a second conference committee be appointed. The Speaker has appointed Representative Berry, chairman, Kaufman and Tate as conferees on the second conference committee.

FIRST REPORT OF FIRST CONFERENCE COMMITTEE

THIS REPORT AMENDS THE
REREVISED BILL

To the President of the Senate and the
Speaker of the House of Representatives:
Your first conference committee appointed on SB00-042, concerning the creation of the Colorado council for persons with disabilities, and making an appropriation in connection therewith, has met and reports that it has agreed upon the following:
1. That the Senate accede to the House amendments made to the bill as said amendments appear in the rerevised bill.
2. That, under the authority granted to the committee to consider matters not at issue between the two houses, the following amendments are recommended:
Amend rerevised bill, page 2, strike lines 2 and 3, and substitute the following:
"24-20-111. Office of governor - task force - council for persons with disabilities - fund - creation. (1) (a) A task force shall be convened under the auspices of the governor's office to:
(I) Explore ways to increase coordination and effectiveness of boards, councils, and commissions concerned with publicly funded services to persons with disabilities;
(II) Examine the issues relating to and prepare for the permanent creation in statute of the Colorado council for persons with disabilities as described in subsection (2) of this section.
(b) The task force shall be made up of representatives from the state boards, councils, and commissions serving persons with disabilities, including but not limited to:
(I) The current Colorado council for persons with disabilities, created by executive order of the governor;
(II) The Colorado developmental disabilities planning council, created in section 27-10.5-203, C.R.S.;
(III) The state rehabilitation council created pursuant to 29 U.S.C. sec. 725;
(IV) The statewide independent living council, created pursuant to the federal "Rehabilitation Act of 1973";
(V) The advisory board on mental health services standards, created in section 27-10-129, C.R.S.;
(VI) The mental health planning and advisory council, created pursuant to the federal "Public Health Service Act";
(VII) The Colorado commission for the deaf and hard of hearing, created in section 26-21-104, C.R.S.;
(VIII) The medicaid advisory committee for persons with disabilities created as an ad hoc committee in the department of health care policy and financing;
(IX) The state medical assistance and services advisory council, created in section 26-4-108, C.R.S.;
(X) The state special education advisory committee, created in section 22-20-104, C.R.S.
(c) The task force shall also include three persons who represent advocacy organizations that represent persons with disabilities on a cross-disability, statewide basis. Such members shall be neither appointees nor employees of any state agency, board, committee, or council represented on the task force.
(d) The governor shall appoint the chairperson for the task force.
(e) The governor's office, the state department of human services, and the state department of health care policy and financing shall participate in the work of the task force and representatives from each entity shall serve as nonvoting ex-officio members of the task force. The governor's office, the state department of human services, and the state department of health care policy and financing shall provide administrative support as needed to the task force within existing appropriations.
(f) The task force shall submit a report on its progress, including recommendations for legislation, if any, to the general assembly and to the governor on or before January 1, 2001.
(g) This subsection (1) is repealed, effective July 1, 2001.
(2) Effective July 1, 2001, for the purposes of promoting".

"SECTION 2. 42-4-1208, Colorado Revised Statutes, is amended BY THE ADDITION OF A NEW SUBSECTION to read:
42-4-1208. Parking privileges for persons with disabilities - applicability. (14) In addition to any other surcharge, a surcharge of five dollars shall be levied against a penalty assessment imposed for a violation of this section. All moneys collected by the department or the clerk of the court pursuant to this subsection (14) shall be transmitted to the state treasurer for credit to the Colorado council for persons with disabilities fund created in section 24-20-111 (6), C.R.S.
SECTION 3. The introductory portion to 42-4-1701 (4) (a) (I), Colorado Revised Statutes, is amended to read:
42-4-1701. Traffic offenses and infractions classified - penalties - penalty and surcharge schedule. (4) (a) (I) Except as provided in paragraph (c) of subsection (5) of this section, every person who is convicted of, who admits liability for, or against whom a judgment is entered for a violation of any provision of this title to which the provisions of paragraph (a) or (b) of subsection (5) of this section apply shall be fined or penalized, and have a surcharge levied thereon pursuant to section 24-4.2-104 (1) (b) (I), C.R.S., in accordance with the penalty and surcharge schedule set forth in sub-subparagraphs (A) to (P) of this subparagraph (I) or a surcharge levied thereon pursuant to section 42-4-1208 (14); or, if no penalty or surcharge is specified in the schedule, the penalty for class A and class B traffic infractions shall be fifteen dollars, and the surcharge shall be two dollars. These penalties and surcharges shall apply whether the defendant acknowledges the defendant's guilt or liability in accordance with the procedure set forth by paragraph (a) of subsection (5) of this section or is found guilty by a court of competent jurisdiction or has judgment entered against the defendant by a county court magistrate. Penalties and surcharges for violating specific sections shall be as follows:
SECTION 4. Appropriation - adjustment in 2000 long bill. (1) In addition to any other appropriation, for the fiscal year beginning July 1, 2000, there is hereby appropriated, out of any moneys in the general fund not otherwise appropriated, to the Colorado council for persons with disabilities fund, created in section 24-20-111 (6), Colorado Revised Statutes, the sum of fifteen thousand dollars ($15,000), and such sum, or so much thereof as may be necessary, is further appropriated, to the office of the governor for allocation to the Colorado council for persons with disabilities for the implementation of this act.
(2) For the implementation of this act, appropriations made in the annual general appropriations act for the fiscal year beginning July 1, 2000, shall be adjusted as follows:
(a) The general fund appropriation to the capital construction fund outlined in section 3 (1) (f) is reduced by fifteen thousand dollars ($15,000).
(b) The capital construction fund exempt appropriation to the department of transportation, construction projects, is reduced by fifteen thousand dollars ($15,000).
SECTION 5. Safety clause. The general assembly hereby finds, determines, and declares that this act is necessary for the immediate preservation of the public peace, health, and safety.".

THIS REPORT AMENDS THE
SECOND REREVISED BILL

To the President of the Senate and the
Speaker of the House of Representatives:
Your second conference committee appointed on SB00-049, concerning the establishment of the obligation of the state for funding special education programs for children with disabilities, and making an appropriation in connection therewith, has met and reports that it has agreed upon the following:
1. That the Senate accede to the House amendments made to the bill, as the amendments appear in the second rerevised bill.
2. That, under the authority granted the committee to consider matters not at issue between the two houses, the following amendment is recommended:
Amend second rerevised bill, page 1, strike lines 5 through 7.
Page 2, strike lines 1 to 15 and substitute the following:
"SECTION 1. Additional funding for special education programs for children with disabilities - adjustment in 2000 long bill. (1) To provide additional funding for special education programs for children with disabilities under section 22-20-114 (1) (b.8), Colorado Revised Statutes, appropriations made in the annual general appropriations act for the fiscal year beginning July 1, 2000, shall be adjusted as follows:
(a) The general fund appropriation to the department of education, for public school finance, special education - children with disabilities, is increased by one million six hundred thousand dollars ($1,600,000), for the implementation of section 22-20-114 (1) (b.8), Colorado Revised Statutes. Said amount shall be in addition to the amount appropriated for the implementation of such section in House Bill 00-1159, enacted at the Second Regular Session of the Sixty-second General Assembly, and shall be distributed in accordance with the provisions of said section. If the additional amount appropriated by this paragraph (a) is more than actually needed to fully fund said section 22-20-114 (1) (b.8), the excess amount shall be distributed by the department of education for the regular special education - children with disabilities program in accordance with the provisions of article 20 of title 22, Colorado Revised Statutes.
(b) The general fund appropriation to the capital construction fund outlined in section 3 (1) (f) is reduced by one million six hundred thousand dollars ($1,600,000).
(c) The capital construction fund exempt appropriation to the department of transportation, construction projects, is reduced by one million six hundred thousand dollars ($1,600,000).";

During 1999, Governor Bill Owens granted one pardon to Marvin Graves, convicted in 1965, in Montezuma County, Colorado, of the crime of burglary (see attached Executive Order of Pardon). No commutations of sentence were granted.
