No action shall be brought questioning the legality of any bonds or loans authorized by this title or any resolution, proceeding, or contract in connection with such bonds or loans on and after thirty days from the effective date of the resolution authorizing the issuance of such bonds or the execution of any loan agreement.".

THIS REPORT AMENDS THE
REREVISED BILL

To the President of the Senate and the
Speaker of the House of Representatives:
Your first conference committee appointed on SB00-124, concerning literacy in early elementary grades, and, in connection therewith, establishing a read-to-achieve program, and making an appropriation in connection therewith, has met and reports that it has agreed upon the following:
1. That the Senate accede to the House amendments made to the bill, as said amendments appear in the rerevised bill, with the following changes:
Amend rerevised bill, page 4, line 9, strike "years, but no grant for any one" and substitute "years.";
line 11, strike "for any one year.".
Page 9, line 10, strike "2005." and substitute "2008.".
Page 10, line 26, strike "(36)" and substitute "(39) (b)".
Page 11, strike lines 1 through 9 and substitute the following:

"SECTION 5. Relationship to Senate Bill 00-071. (1) If both this act and Senate Bill 00-071 are enacted and become law, the provisions of both bills, including the appropriations contained therein, shall be given effect and harmonized except as follows:
(a) The introductory portion to 22-7-506 (3) (a) and 22-7-506 (5) (a), Colorado Revised Statutes, as enacted in this act shall supersede the provisions of the introductory portion to 22-7-506 (3) (a) and 22-7-506 (5) (a), Colorado Revised Statutes, as enacted in Senate Bill 00-071;
(b) 24-34-104 (36), Colorado Revised Statutes, as amended in Senate Bill 00-71, is amended to read:
24-34-104. General assembly review of regulatory agencies and functions for termination, continuation, or reestablishment. (36) The following agencies, functions, or both, shall terminate on July 1, 2005: The fire suppression program of the division of fire safety created pursuant to sections 24-33.5-1204.5, 24-33.5-1206.1, 24-33.5-1206.2, 24-33.5-1206.3, 24-33.5-1206.4, 24-33.5-1206.5, 24-33.5-1206.6, and 24-33.5-1207.6, C.R.S. and the read-to-achieve board created pursuant to section 22-7-506, C.R.S.
(c) 22-7-506 (4), Colorado Revised Statutes, as enacted in both this act and in Senate Bill 00-071 is REPEALED AND REENACTED, WITH AMENDMENTS, to read:
22-7-506. Read-to-achieve grant program - board created - fund. (4) (a) (I) There is hereby established in the state treasury the read-to-achieve cash fund, referred to in this section as the "cash fund". The cash fund shall consist of moneys appropriated thereto pursuant to paragraph (b) of this subsection (4) and any other moneys that may be made available by the general assembly. Subject to appropriation by the general assembly, moneys in the cash fund shall be used to provide grants to schools pursuant to this section. Any moneys not provided as grants to schools may be invested by the state treasurer as provided in section 24-36-113, C.R.S. All interest derived from the deposit and investment of moneys in the cash fund shall be credited to the cash fund. Any amount remaining in the cash fund at the end of any fiscal year shall remain in the cash fund and shall not be credited or transferred to the general fund or to any other fund.
(II) Up to one percent of the moneys in the cash fund may be used for the expenses incurred by the read-to-achieve board in administering this section. If the read-to-achieve board is unable to administer this program with existing personnel, the read-to-achieve board shall contract with private sources for such services.
(b) (I) Beginning with the 2000-01 fiscal year, and for each fiscal year thereafter so long as the state receives moneys pursuant to the master settlement agreement, the general assembly shall annually appropriate to the fund nineteen percent of the amount of moneys transmitted to the state treasurer in accordance with the master settlement agreement, other than attorney fees and costs, for the preceding fiscal year; except that the amount so appropriated to the fund in any fiscal year shall not exceed nineteen million dollars. The general assembly shall appropriate the amount specified in this paragraph (c) from moneys credited to the tobacco litigation settlement cash fund created in section 24-22-115, C.R.S.
(II) Notwithstanding the provisions of subparagraph (I) of this paragraph (b), for the fiscal year in which the first payment of moneys pursuant to the master settlement agreement is received, the percentage appropriated to the fund shall be calculated on the total amount of moneys received by the state pursuant to the master settlement agreement, other than attorney fees and costs, during that fiscal year, minus thirty-three million dollars.
(2) This section 5 shall take effect only if Senate Bill 00-071 is enacted and becomes law.".

(II) The commissioner of education;
(III) The executive director of the department of health care policy and financing;

(VI) The executive director of the department of local affairs;
(VII) The executive director of the department of natural resources;
(VIII) The executive director of the department of public health and environment;
(IX) The executive director of the department of public safety; and
(X) The executive director of the department of transportation.".

"25-20.5-110. Coordinated comprehensive community-based prevention and intervention services - pilot program - reports - repeal. (1) There is hereby created, to be operated by the division, the coordinated response to comprehensive community-based prevention and intervention services pilot program.
(2) (a) The division shall develop a request for proposals to design comprehensive, community-based prevention and intervention services intended to strengthen children, youth, families, and communities while reducing high-risk behaviors. The request for proposals shall be distributed to local governments and prevention and intervention services providers throughout the state. The division shall develop time frames, application processes, and other tasks required to implement the pilot program.
(b) Responses to the request for proposals developed pursuant to paragraph (a) of this subsection (2) shall be due by May 1, 2001, and shall include, but need not be limited to, demonstration of the following criteria:
(I) The support and collaboration of key stakeholders within the community that include, but are not limited to, boards of county commissioners, school district officials, elected and appointed municipal officials, local law enforcement agencies, county departments of social services, criminal justice representatives, county health departments, religious organizations, community organization representatives, local prevention and intervention providers, and youth;
(II) The presence of an existing community strategic plan evidencing collaboration or partnerships among interested stakeholders, or the development of a locally prepared, comprehensive, community strategic plan for the delivery of prevention and intervention services that meets parameters established by the division;
(III) A plan to pool funds to create a single location in the community for children, youth, families, and community to receive all prevention and intervention services; and
(IV) The utilization of programs and strategies that are science- or research-based or have a proven record of effectiveness.
(3) (a) By May 15, 2001, from the responses to the request for proposals submitted pursuant to subsection (2) of this section, the division shall select not more than twelve pilot site communities to participate in the pilot program. Of the sites designated, not more than one-third may be located in the Denver metropolitan area and at least one site shall be located in each of the following communities:
(I) A rural community;
(II) An urban community other than the Denver metropolitan area; and
(III) A community located west of the continental divide.
(b) To qualify for the pilot program, a community, to the extent possible, shall unify all funding streams for prevention and intervention programs.
(4) The proposals submitted pursuant to subsection (2) of this section may include a request for the waiver of statutory requirements or rules. Such waivers are subject to the approval of the division, after consultation with other state agencies operating affected prevention and intervention programs.
(5) (a) On or before June 1, 2001, the division shall conduct an orientation program for the selected communities and the state agencies that operate prevention and intervention programs.
(b) On or before September 1, 2001, the selected communities shall submit to the division comprehensive community prevention and intervention plans that include but are not limited to plan outcomes and indicators of success. On or before October 1, 2001, the selected communities shall submit to the division proposals for waivers, administrative efficiencies and coordination, and any realigning of existing funding.
(c) On or before November 1, 2001, the division shall notify communities of initial decisions on the proposals submitted pursuant to paragraph (b) of this subsection (5).
(6) (a) On or before June 1, 2002, the division shall prepare and submit to the joint budget committee and to the health, environment, welfare, and institutions committees of the senate and house of representatives an interim assessment of the pilot program to determine the effectiveness and impact of unifying the funding sources for prevention and intervention services delivered to children, youth, families, and communities.
(b) The assessment, at a minimum, shall include consideration of the following:
(I) The feasibility of unifying all state funding sources for prevention and intervention services;
(II) The barriers to the delivery of quality prevention and intervention services and any changes that may be made to eliminate the barriers; and
(III) Whether the outcomes under the pilot program are measurably better than outcomes in other areas of the state in which the program is not operating.
(c) On or before January 1, 2004, the division shall prepare and submit to the joint budget committee and to the health, environment, welfare, and institutions committees of the senate and house of representatives a final assessment of the pilot program and any recommendations for continuation or modification of the pilot program.
(7) This section is repealed, effective July 1, 2004.".

25-17-202. Waste tire recycling development fee - cash fund created. (1) (a) (I) On and after January 1, 1994, and prior to the date described in section 29-4-719.1 (2) (f) (IV.5), C.R.S., a recycling development fee of one dollar shall be collected on any waste motor vehicle tire for any passenger vehicle, including any truck, weighing less than fifteen thousand pounds. In addition, such fee shall be collected on truck tires, including truck tractor, trailer, and semitrailer, weighing more than fifteen thousand pounds; except that no fee shall be collected for tires that are recapped or otherwise reprocessed for use. The fee authorized by this section shall be collected only at such time as the owner of the tire delivers or transfers the waste tire to a retailer of new tires for disposal.
(II) On and after the date described in section 29-4-719.1 (2) (f) (IV.5), C.R.S., the recycling development fee described in subparagraph (I) of this paragraph (a) shall be seventy-five cents.
SECTION 3. 29-4-719.1 (2) (f), Colorado Revised Statutes, is amended BY THE ADDITION OF A NEW SUBPARAGRAPH to read:
29-4-719.1. Economic development fund - repeal. (2) (f) (IV.5) On the date that the moneys provided pursuant to this paragraph (f) reaches the sum of ten million dollars, the treasurer shall certify to the general assembly in writing that the sum of such moneys has reached such amount.";
