REPORTS OF COMMITTEES OF REFERENCE
BUSINESS AFFAIRS AND LABOR
After consideration on the merits, the Committee recommends the following:
HB00-1346 be amended as follows, and as so amended, be referred to the Committee on Appropriations with favorable recommendation:
Amend printed bill, strike everything below the enacting clause, and substitute the following:
"SECTION 1. 8-47-107, Colorado Revised Statutes, is amended to read:
8-47-107. Adoption of rules. The director has the power to adopt reasonable and proper rules and regulations relative to the administration of articles 40 to 47 of this title and proper rules and regulations to govern proceedings and hearings of the division. and the director has the discretion to amend said rules and regulations from time to time. No such rule shall limit the jurisdiction of an administrative law judge in the division of administrative hearings to hear and decide all matters arising under articles 40 to 47 of this title. The executive director of the department of personnel has the power to adopt reasonable and proper rules to govern procedures for hearings in workers' compensation cases before an administrative law judge in the division of administrative hearings. Such rules and regulations shall be promulgated in accordance with section 24-4-103, C.R.S.
SECTION 2. 24-30-1001, Colorado Revised Statutes, is amended BY THE ADDITION OF A NEW SUBSECTION to read:
24-30-1001. Division of administrative hearings. (3.5) In order to perform the duties and functions set forth in this part 10, the executive director of the department of personnel shall, in relation to departments, institutions, and agencies of the executive branch:
(a) Adopt rules to permit the rotation of cases heard before administrative law judges in the division of administrative hearings, including the rotation of prehearing conference functions in workers' compensation cases under section 8-43-207.5, C.R.S.;
(b) Adopt rules to govern the geographic rotation of administrative law judges in the division of administrative hearings;
(c) Adopt rules governing hearing procedures for hearings before administrative law judges in the division of administrative hearings.
SECTION 3. Effective date - applicability. (1) This act shall take effect at 12:01 a.m. on the day following the expiration of the ninety-day period after final adjournment of the general assembly that is allowed for submitting a referendum petition pursuant to article V, section 1 (3) of the state constitution; except that, if a referendum petition is filed against this act or an item, section, or part of this act within such period, then the act, item, section, or part, if approved by the people, shall take effect on the date of the official declaration of the vote thereon by proclamation of the governor.
(2) The provisions of this act shall apply to the conduct of hearings by administrative law judges in the division of administrative hearings in the department of personnel on or after the applicable effective date of this act.".
HB00-1466 be amended as follows, and as so amended, be referred to the Committee of the Whole with favorable recommendation:
Amend printed bill, page 2, line 17, strike "such person may or insurer shall" and substitute "such person may, and such insurer shall,";
line 23, strike "person, insurer," and substitute "insurer";
line 26, strike "act to:" and substitute "act, upon request, to:".
Page 3, line 4, strike "insurer or" and substitute "insurer or";
line 8, strike "may" and substitute "may, and any insurer that has reason to believe the same shall,";
line 14, strike "litigation." and substitute "litigation, but only to the extent that the insurer or person disclosing the information is granted immunity under section 10-4-1005.";
after line 17, insert the following:
"(b) Paragraph (a) of this subsection (8) shall not be construed to prohibit the admission of evidence of a fraudulent insurance act:
(I) In any civil litigation involving such fraudulent insurance act; or
(II) In any civil litigation involving the alleged disclosure of information as to which the insurer or person alleged to have made such disclosure does not have immunity under section 10-4-1005.";
line 18, strike "(b)" and substitute "(c)";
line 22, strike "applicant." and substitute "applicant; except that such request and any such release of information shall be solely for the purpose of detecting, investigating, preventing, or prosecuting an actual or suspected fraudulent insurance act. Information so provided shall not be used for underwriting or rating purposes except in connection with an application or policy under which a fraudulent insurance act was committed.".
Page 4, strike line 21 and substitute the following:
"10-4-1003 (8) (c) solely for the purpose of detecting, investigating, preventing, or prosecuting an actual or suspected fraudulent insurance act. Information so provided shall not be used for underwriting or rating purposes except in connection with an application or policy under which a fraudulent insurance act was committed.".

HB00-1469 be amended as follows, and as so amended, be referred to the Committee on Appropriations with favorable recommendation:

After consideration on the merits, the Committee recommends the following:
HB00-1472 be amended as follows, and as so amended, be referred to the Committee of the Whole with favorable recommendation:

"(II) The separate segregated account of any partnership, committee, association, corporation, labor organization, political party, or other organization or group of persons that has accepted total contributions in excess of five hundred dollars or made total expenditures in excess of five hundred dollars to support or oppose any ballot issue or ballot question. For purposes of this subparagraph (II), the term "expenditure" does not include expenditures made by persons in the regular course and scope of their business or in connection with communications sent solely to their members. The term "expenditure" also does not include a contribution, as defined in subsection (4) of this section.".
Page 3, line 2, after "committee", insert "that is described in section 1-45-103 (8) (a) (II) but not in section 1-45-103 (8) (a) (I)";

This Report Amends the Rerevised Bill.
To the President of the Senate and the
Speaker of the House of Representatives:
Your first conference committee appointed on HB00-1267, concerning the administration of the "Pet Animal Care and Facilities Act" by the department of agriculture, has met and reports that it has agreed upon the following:
1. That the House accede to the Senate amendments made to the bill, as said amendments appear in the rerevised bill, with the following changes:
Amend rerevised bill, page 5, after line 5, insert the following:
"SECTION 9. Article 80 of title 35, Colorado Revised Statutes, is amended BY THE ADDITION OF A NEW SECTION to read:
35-80-112.5. Denial of license - animal cruelty conviction. (1) The commissioner, pursuant to the provisions of article 4 of title 24, C.R.S., may deny, refuse to renew, or revoke any license authorized under this article if the applicant or licensee has been convicted of cruelty to animals pursuant to article 9 of title 18, C.R.S., or any similar statute of any other state.
(2) Notwithstanding subsection (1) of this section, the commissioner, pursuant to the provisions of article 4 of title 24, C.R.S., shall deny, refuse to renew, or revoke any license authorized under this article if the applicant or licensee has been convicted, at any time, of one or more violations of section 18-9-202, C.R.S., the underlying factual basis of which has been found by the court to include the knowing or intentional torture or torment of an animal which needlessly injures, mutilates, or kills an animal.".
