CONSIDERATION OF SENATE AMENDMENTS TO HOUSE BILLS

APPROPRIATIONS
After consideration on the merits, the Committee recommends the following:
HB00-1016 be amended as follows, and as so amended, be referred to the Committee of the Whole with favorable recommendation:
Amend printed bill, page 6, after line 26, insert the following:
"SECTION 4. Appropriation - adjustments in 2000 long bill. (1) For implementation of this act, appropriations made in the annual general appropriations act for the fiscal year beginning July 1, 2000, shall be adjusted as follows:
(a) The appropriation to the department of labor and employment for the executive director's office is decreased by forty-four thousand one hundred eighty-nine dollars ($44,189). Such sum shall be from the workers' compensation cash fund.
(b) The appropriation to the department of labor and employment for the division of workers' compensation is decreased by five hundred fifty-five thousand two hundred thirty-seven dollars ($555,237) and 8.0 FTE. Such sum shall be from the workers' compensation cash fund.
(c) The appropriation to the department of labor and employment for administrative law judge services in the division of workers' compensation is increased by five hundred ninety-nine thousand four hundred twenty-six dollars ($599,426). Such sum shall be from the workers' compensation cash fund.
(d) The appropriation to the department of personnel for the executive director's office is increased by forty-four thousand one hundred eighty-nine dollars ($44,189) for allocation to the division of administrative hearings for the provision of administrative law judge services to the department of labor and employment. Such sum shall be from cash funds exempt received from the department of labor and employment out of the appropriation made in subsection (c) of this section.
(e) The appropriation to the department of personnel for the division of administrative hearings is increased by five hundred fifty-five thousand two hundred thirty-seven dollars ($555,237) and 8.0 FTE for the provision of administrative law judge services to the department of labor and employment. Such sum shall be from cash funds exempt received from the department of labor and employment out of the appropriation made in subsection (c) of this section.".
Renumber succeeding section accordingly.
Page 1, line 112, strike "judges." and substitute "judges, and making an appropriation therefor.".
HB00-1069 be amended as follows, and as so amended, be referred to the Committee of the Whole with favorable recommendation:

"(2) The moneys appropriated by this section shall, if any project for which such moneys are appropriated is initiated within the fiscal year, remain available until completion of the project or for a period of three years, whichever comes first, at which time the unexpended and unencumbered balances of such appropriation shall revert to the aviation fund.".
HB00-1081 be amended as follows, and as so amended, be referred to the Committee of the Whole with favorable recommendation:
Amend printed bill, page 6, after line 13, insert the following:
"SECTION 3. Appropriation. In addition to any other appropriation, there is hereby appropriated, out of any moneys in the public education voluntary contribution fund not otherwise appropriated, to the department of revenue, for the fiscal year beginning July 1, 2000, the sum of sixty-nine thousand three hundred dollars ($69,300), or so much thereof as may be necessary, for the implementation of this act.".

"35-80-116.5. Pet overpopulation control authority - creation - duties and powers - creation of pet overpopulation control fund. (1) (a) The general assembly hereby declares that it is in the public interest and welfare that owners of cats and dogs be authorized and encouraged to act jointly and in cooperation in stimulating, by research, education, advertising, and other methods, the promotion of a program of pet overpopulation control in the state. It is the intent and purpose of this article to authorize and provide a method and procedure for effectively correlating and encouraging the promotion of spaying and neutering of cats and dogs, the coordination with local communities for the spaying and neutering, and the financing thereof, pursuant to the powers of the general assembly as authorized by law.
(b) There is hereby created the Colorado pet overpopulation control authority that is a body corporate and a political subdivision of the state. The authority is not an agency of state government and is not subject to administrative direction by any state agency except:
(I) As provided in this article; and
(II) For purposes of the "Colorado Governmental Immunity Act", article 10 of title 24, C.R.S.
(2) (a) The powers of the authority shall be vested in a board of directors, which shall be composed of:
(I) One representative of the animal assistance foundation;
(II) One representative of the Colorado federation of animal welfare agencies;
(III) One representative of a state veterinary medical association;
(IV) One representative of an association organized for Colorado animal control officers;
(V) One representative from the department of agriculture;
(VI) One member of the public who has no financial affiliation with any of the organizations listed in this subsection (2); and
(VII) One member from an animal rescue organization.
(b) The commissioner shall appoint the board members to three-year terms. The terms of no more than three members shall expire on the same year. Each member serves at the pleasure of the commissioner and shall continue in office until the member's successor is appointed and qualified. Initial members of the authority shall be appointed no later than September 1, 2001.
(c) On the expiration of the term of a member of the board, that member's successor shall be appointed by the commissioner for a term of three years; except that, in the case of a vacancy, the commissioner shall appoint a person who shall serve for the unexpired term.
(3) (a) Each board member shall meet the following qualifications at the time of appointment and throughout the member's term of office:
(I) Residency in this state; and
(II) Demonstration of an active interest in the education of the community regarding the benefits of pet overpopulation control in Colorado.
(b) The commissioner shall immediately declare the office of any member of the board vacant whenever the commissioner finds that the member is not qualified under this subsection (3) or that the member is unable to perform the duties of the office.
(4) Members shall serve without compensation.
(5) (a) The board may:
(I) Adopt policies related to how the board may promote a program concerning pet overpopulation control in this state;
(II) Adopt an education program concerning the overpopulation of cats and dogs emphasizing the importance of spaying and neutering;
(III) Develop, adopt, and implement a process to fund and expend moneys for the activities and responsibilities of the board. Funding for the board includes the moneys available in the pet overpopulation control fund created in subsection (6) of this section;
(IV) Accept gifts, grants, and donations, including personal services, for the activities and responsibilities of the board. Any gift, grant, or donation other than personal services shall be deposited into the pet overpopulation control fund created in subsection (6) of this section.
(V) Develop, adopt, and implement a process to work with local veterinarians, communities, and other interested persons to increase spaying and neutering of cats and dogs;
(VI) Cooperate with any local, state, or nationwide organization or agency engaged in work or activities similar to that of the board and enter into contracts with the organizations or agencies for carrying out joint programs; and
(VII) Enter into contracts that it deems appropriate to carry out the purposes of the board as authorized by this article.
(b) The board may contract for:
(I) The implementation of pet overpopulation control education and promotion programs with any public or private nonprofit, not-for-profit, for-profit, or volunteer organization to create an educational program to heighten the awareness of the public regarding cat and dog overpopulation and methods to control pet overpopulation, including spaying and neutering of cats and dogs. The board may require an annual report from any public or private nonprofit, not-for-profit, for-profit, or volunteer organization that receives moneys from the board pursuant to this section.
(II) The provision of spaying and neutering services for cats and dogs or the facilitation of this process by any public or private nonprofit, not-for-profit, for-profit, or volunteer organization; and
(III) Fund-raising to facilitate and coordinate the activities described in this subsection (5).
(6) Donations collected pursuant to subsection (5) and section 42-3-115.2, C.R.S., shall be transmitted to the state treasurer and credited to the pet overpopulation control fund, which fund is hereby created in the state treasury. All interest derived from the deposit and investment of moneys shall be credited to the fund. All unexpended and unencumbered moneys remaining in the fund at the end of any fiscal year shall remain in the fund and not revert back to the general fund or any other fund or be used for any other purpose. Such moneys shall be appropriated continually to the state treasurer who shall:
(a) Reimburse the department of revenue for the initial, reasonable costs and programming fees incurred by the distributive data processing system special purpose account in the highway users tax fund as a result of special license plates issued pursuant to section 42-3-115.2, C.R.S.; and
(b) At least quarterly, transfer all available moneys in the pet overpopulation control fund to the pet overpopulation control authority. The pet overpopulation control authority shall expend moneys from the pet overpopulation control fund for the implementation of this section.".
